Flamingo Road in Davie for the potential use by the Broward County Supervisor of Elections; enabling the Board to provide any required direction to County staff consistent with the below item summary. Summary Explanation/Background
On December 4, 2018 (Item No. 53), the Board of County Commissioners approved the Purchase and Sale Agreement (Agreement) between Broward County and Florida Aquatic Nurseries, Inc. for the acquisition of four parcels measuring approximately 296,525 square feet located at 780 S. Flamingo Road in Davie at a purchase price of $6,662,500. The 90-day inspection period ends on March 5, 2019 and, if the County elects not to proceed with the purchase, a notice of termination must be provided to Seller by the end such date. The Agreement was executed on December 5, 2018.

Due diligence is complete. The survey and title have been reviewed and accepted. The Extended Phase II Environmental Site Assessment was completed and revealed that Arsenic soil contamination (surface and subsurface) is present. No contaminants of concern were detected in the groundwater sample collected. Additional remediation and/or engineering, legal and administrative work will be required.

New programming for the Supervisor of Elections, identified after the Agreement was executed, would require the construction of an approximately 95,000 square feet warehouse plus 40,000 square feet of office space to meet operational needs. This construction would be challenging due to the parcels’ size, parking requirements and current Town of Davie zoning regulations.

Alternatively, this property is deemed to be a suitable site for transit oriented development that includes mixed use.  Staff went before the Town of Davie Council meeting on February 20, 2019. The District Council member is not supportive of the County purchasing this parcel and many Council members indicated they would defer to her. However, the Council members were open to discussion pending receiving further information from the County, as well as, the neighboring community.

Fiscal Impact
Fiscal Impact/Cost Summary:
The source of funds for this acquisition are located in the General Capital Fund. In addition to the purchase price of $6,662,500, there will be normal and customary closing costs. These costs include, but are not limited to, an environmental assessment, survey, and title insurance, which are anticipated not to exceed $337,500. The chart-field to be used for this transaction is 30205-30205-61208000-560010-BRW01-105221-LAND.
