MOTION TO ADOPT Resolution No. 2019-090 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, April 9, 2019, at 10:00 a.m. in Room 422 of the Governmental Center, 115 South Andrews Avenue, Fort Lauderdale, Florida to vacate a 20-foot-wide canal maintenance and underground utility easement, also being the southerly 20 feet of a 50-foot canal easement lying within Tract A of Parkwood VI Plat, as recorded in Plat Book 148, Page 37 of the Public Records of Broward County, Florida, located at 4153-4273 Northwest 66 Drive, 6675 Northwest 42 Terrace, and 6660 Northwest 41 Terrace in City of Coconut Creek; Petitioners: Nicholas Beaufrand & Cecilia M. Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Planning and Development Management Division has received a request to vacate a portion of a 20-foot-wide canal maintenance and underground utility easement, also being the southerly 20 feet of a 50-foot canal easement lying within Tract A of Parkwood VI Plat, as recorded in Plat Book 148, Page 37, and are located at 4153-4273 Northwest 66 Drive, 6675 Northwest 42 Terrace, and 6660 Northwest 41 Terrace in City of Coconut Creek. Vacating these easements will provide clear and unencumbered title to the property owners.

The City of Coconut Creek approved these vacations by adopting Ordinance No. 2017-011 on April 27, 2017. Review of this application by the applicable County agencies and utility companies indicates that the utility easements are currently unused, and there are no plans for future use. No objections to this vacation were raised by any of the reviewing agencies.

This vacation application has been reviewed and approved as to form by the Office of the County Attorney.
