Minione Plat (Plat Book 103, Page 11); located at 1600 West Sample Road in the City of Pompano Beach; Petitioner: Public Storage, a real estate investment trust, successor in interest by operation of a merger to Partners Preferred Yield II, Inc.; Agent: James Kahn, Keith & Associates; Application for Vacation and Abandonment: 2018-V-17. Board approval is required to vacate utility easements pursuant to Broward County Administrative Code, Chapter 25.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The portions of two 12-foot-wide utility easements (O.R. Book 9383, Page 14) and a 20-foot-wide utility easement (Instrument No. 114817903) to be vacated lie within a portion of Tract A of the F.F. Minione Plat (Plat Book 103, Page 11). This property is located at 1600 West Sample Road, in the City of Pompano Beach. Vacating these utility easements will provide clear and unencumbered title to the property owner, Public Storage, a Maryland real investment trust, successor in interest by operation of merger to Partners Preferred Yield II, Inc.

The City of Pompano Beach approved this vacation by adopting Resolution No. 2017-685 on December 12, 2017. Review of this application by the applicable County agencies and utility companies indicates that the utility easements are currently unused, and there are no plans for future use. No objections to this vacation were raised by any of the reviewing agencies.

This vacation application has been reviewed and approved as to form by the Office of the County Attorney.
