MOTION TO APPROVE Agreement between Broward County and SP Plus Curbside Management Joint Venture for Ground Transportation Management Services at Broward County's Fort Lauderdale-Hollywood International Airport, Request for Proposals No. 2018-06-05-0-AV-01, for an initial five year term. The Agreement shall begin on May 1, 2019 and end five years from that date for an estimated compensation amount of $26,093,171 and reimbursables are established in the not-to-exceed amount of $5,038,000; with an estimated contract value for five years of $31,131,171; and authorize the Mayor and Clerk to execute same.

VOTE:  8-0.  Commissioner Geller was not present.

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

This action approves the Agreement between Broward County and SP Plus Curbside for Ground Transportation Management Services at FLL.

The Office of Economic and Small Business Development ("OESBD") established an Airport Concession Disadvantaged Business Enterprise ("ACDBE") participation goal of 25% for this procurement. SP Plus committed to a 30.50% ACDBE participation which has been reviewed and approved by the OESBD.

This procurement was solicited to engage the services of a qualified and experienced firm to administer and manage the functions of ground transportation and curbside management at FLL.

On June 5, 2018 (Item No. 67), the Board approved the Request for Proposals No. 2018-06-05-0-AV-01 ("RFP"), Ground Transportation Management Services at FLL to administer the Ground Transportation Program ("Program") to provide management and monitoring of the activities for all commercial motor carriers, courtesy operators, and Transportation Network Companies at FLL. The RFP was advertised and at the time of the opening deadline, 4:30 p.m. on August 17, 2018, two firms submitted proposals.

On Tuesday, September 4, 2018, a Combination Initial and Final Evaluation Committee meeting was held. The Evaluation Committee reviewed and evaluated the proposals submitted by the firms that were determined to be responsive and responsible to the requirements of the RFP. After presentations, evaluation, and scoring, the Evaluation Committee named SP Plus Curbside Management Joint Venture as the first-ranked firm and ABM Aviation, Inc. as the second-ranked firm.

The Evaluation Committee’s recommendation of ranking was posted on the Broward County's Aviation Department ("BCAD") website from September 7, 2018, to September 13, 2018. This provided an opportunity for any aggrieved proposer to file a formal protest. There was no protest field within this timeframe.

The Evaluation Committee consisted of:

The Agreement provides SP Plus Curbside the non-exclusive right to administer and manage the ground transportation activities of all commercial vehicles including, but not limited to, taxicabs, prearranged vehicles, courtesy vehicles (hotel/motel, off-airport parking, and off-airport rental car shuttles), shared ride vehicles, and TNC vehicles at FLL. SP Plus Curbside shall provide service 24 hours per day, 365 days per year when commercial vehicles are present at FLL. The term shall commence on May 1, 2019, and shall end five years thereafter.

Compensation to SP Plus Curbside for performing the ground transportation management services is based on a fully burdened hourly rate per employee work hour by job classification. The maximum not-to-exceed amount of compensation during the first contract year is $4,794,038.

Reimbursables are established in the not-to-exceed amount of $5,038,000 for the five year term. Reimbursables include costs related to the rental of holding lot restrooms and tents, trash pick-up and disposal service, utility costs at the SP Plus Curbside on-Airport office facility and lease costs if SP Plus Curbside is required to move off-Airport, AVI system costs including readers and other associated equipment, ground transportation software and technology costs including maintenance, updates, and support, and future expansion or addition of holding lots.

Compensation in subsequent years is subject to:

Adjustment to the lesser of the change in the U.S. Department of Labor Consumer Price Index- All Urban Consumers (Series ID CUURA320SA0) for the Miami-Fort Lauderdale Area (CPI) or 3%.

In accordance with the Living Wage Ordinance, Sections 26-100 et. Seq. of the Broward County Code of Ordinances, the Agreement is subject to the Living Wage as a Ground Transportation Management Services Concession Contract.

In the event the Living Wage Ordinance is amended to increase the health care benefit amount to $3.44 on January 1, 2021, the fully burdened rates (“Adjusted Rates”) have been established and shall become effective on January 1, 2021. If the Living Wage Ordinance is not amended to increase the health care benefit to $3.44 per hour on January 1, 2021, the Adjusted Rates shall be null and void.

In the event the Living Wage Ordinance is amended during the term of this Agreement to provide for adjustment to the living wage or health care benefit amount, as defined in the Living Wage Ordinance, in excess of the adjustments currently authorized (“Excess Adjustment”), and SP Plus Curbside is able to demonstrate to the Contract Administrator’s satisfaction that the Excess Adjustment impacts it actual costs in providing ground transportation services, the County  and SP Plus Curbside agree to meet to negotiate in good faith an adjustment to the fully burdened rates.

The proposed Agreement has been reviewed and approved as to form by the Office of the County Attorney.

Fiscal Impact
Fiscal Impact/Cost Summary:
The estimated cost for this agreement is approximately $31,131,171 payable from the Enterprise Fund. Fiscal Year 2019 spending will be approximately $5,100,000 which is included in the Fiscal Year 2019 budget.
