AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO LICENSING OF MOTOR VEHICLE REPAIR SHOPS, CERTIFICATION OF MOTOR VEHICLE REPAIR TECHNICIANS, AND PERMITTING OF TRAINEES AND LUBE AND TIRE SPECIALISTS; AMENDING SECTION 20-176.77 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

B. MOTION TO CONSIDER adoption of a Resolution No. 2019-081 Amending the Broward County Administrative Code, the title of which is as follows:

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, AMENDING SECTION 40.50 OF THE BROWARD COUNTY ADMINISTRATIVE CODE (“ADMINISTRATIVE CODE”);  AMENDING THE EFFECTIVE DATES FOR AUTOMOBILE TECHNICIAN CERTIFICATIONS, AND TRAINEE AND LUBE AND TIRE SPECIALIST PERMITS; PROVIDING FOR A ONE-TIME ADJUSTMENT TO FEES; REMOVING PROVISIONS RELATING TO TRANSPORTATION NETWORK COMPANIES AND CERTIFIED MOTOR CARRIERS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A. A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of February 12, 2019.
 
B. A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners at its meeting of February 12, 2019.
What Action Accomplishes
A. Enables the Board to consider proposed amendments to the Broward County Code of Ordinances to allow for more efficient distribution of licensing renewal deadlines for certifications of automobile technicians and permits for trainees and lube and tire specialists.

B. Enables the Board to consider proposed Administrative Code amendments that would provide for a one-time fee adjustment for automobile technician certifications and trainee and lube and tire specialist permits, and amendments to Section 40.50 related to fees for motor vehicle repair shop licenses, automobile technician certifications, permits for trainees and lube and tire specialists, transportation network company licenses, and certified motor carrier licenses.

Summary Explanation/Background
The Environmental and Consumer Protection Division (“ECPD”) regulates the procedures for applications, renewals, and fees for certified motor vehicle technicians, trainees, and lube and tire specialists under Chapter 20 of the Broward County Code of Ordinances (“Code”). Currently, applications for certifications and permits, along with several other licenses, are all renewed annually in September, thereby causing delays due to the high volume of renewal applicants. The proposed Ordinance alleviates delays by providing the ECPD the flexibility to determine the dates on which licenses and permits will be renewed. At the request of the ECPD, no further changes to Chapter 20 of the Code have been made at this time.

Section 40.50 of the Broward County Administrative Code prescribes licensing fees for motor vehicle repair shops, automobile technician certifications, and permits for trainees and lube and tire specialists. The proposed Resolution further facilitates the alleviation of delays associated with certifications and permits by providing a one-time adjustment to the renewal fees for certifications and permits to allow the ECPD to stagger the renewal dates. Additionally, the proposed Resolution removes the current requirement that licenses, certifications, and permits be renewed at a time certain. Further, the proposed Resolution eliminates provisions relating to licensing fees for transportation network companies (“TNCs”) and certified motor carriers as Broward County, due to a state preemption, no longer regulates TNCs and certified motor carriers.
