MOTION TO ADOPT Resolution No. 2019-084 approving and authorizing the license of approximately ten acres of land located at 19801 Sheridan Street in the Broward Municipal Services District to The Florida Research Institute for Equine Nurturing, Development and Safety, Inc. for a term of one year plus four successive one-year renewals at a rental rate of $1 per annum to be used to provide shelter for horses with Equine Infectious Anemia and other related services; and authorizing the County Administrator to approve and execute the license agreement subject to the review and approval as to legal sufficiency by the Office of the County Attorney. (Commission District 5)

Why Action is Necessary
Board of County Commissioners' approval is required to license property pursuant to Florida Statutes, Section 125.38 and Broward County Administrative Code, Section 6.23 and to delegate authority to the County Administrator to enter into agreements.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

Broward County has been licensing approximately ten acres of land to The Florida Research Institute for Equine Nurturing, Development and Safety, Inc. (F.R.I.E.N.D.S.) for  use as a shelter for horses with Equine Infectious Anemia and other related services since 1989. The licensed premises is a portion of County-owned property identified by Folio Number 5139-02-05-0010 and is located at 19801 Sheridan Street in the Broward Municipal Services District. The term of the current license agreement expires on February 28, 2019. 

Pursuant to Florida Statutes, Section 125.38, the Board of County Commissioners must adopt a resolution when allowing a non-profit to use County-owned property for a public or community interest and welfare. A new agreement is being negotiated which would grant F.R.I.E.N.D.S. a license to use the premises for an additional one year plus four one-year renewals at an annual rent of $1. The County has the right to terminate the license agreement at any time with 60 days notice. F.R.I.E.N.D.S. has the obligation to maintain the property.
