MOTION TO AWARD fixed contract to the low responsive, responsible bidder, Continental Construction USA, LLC, for West Regional Terminal ADA Site Improvements, Bid No. PNC2114457B1, for the Transit Division, in the amount of $512,571, which includes allowances in the amount of $50,000 to be completed within 365 calendar days from the Project Initiation Date listed in the Notice to Proceed, contingent upon the receipt and approval of insurance/performance and payment guaranty. (Commission District 5)

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Provides all labor, materials, equipment, services and incidentals to furnish and install Americans with Disabilities Act (ADA) site improvements and selected transit amenities at Broward County's West Regional Terminal.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT/TRANSIT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
 
The Office of Economic and Small Business Development (OESBD) established a Disadvantaged Business Enterprise (DBE) goal of 15% for this contract. Continental Construction USA, LLC committed to 40% DBE participation, which has been reviewed and approved by the OESBD (Exhibit 2).
 
This contract provides for all labor, materials, equipment, services and incidentals for site and civil modifications, installation of specified electrical components, landscaping and irrigation improvements, and installation of a cast-in-place concrete/masonry bus shelter at Broward County's West Regional Terminal. In addition, vendor is to furnish and install selected transit amenities at the site. All work shall be in compliance with the “Americans with Disabilities Act” (ADA).
 
This procurement carries a 100% performance and payment guaranty. The Purchasing Division confirmed with the surety company that Continental Construction USA, LLC has the capacity to obtain the required guaranty.
 
The allowances incorporated into this contract in the amount of $50,000 include: $10,000 for permit fees; $15,000 for specialized construction activities and $25,000 for pass-thru parts, materials and miscellaneous items. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor's actual cost without mark-up.
 
The Director of Purchasing has determined the low bidder, Primus Construction Services, LLC, to be non-responsive for failure to submit the Buy America Certification form, as required by the Federal Transit Administration, United States Department of Transportation Funding Supplement, at the time of bid submission.
 
The initial bid submitted by Continental Construction USA, LLC was $524,990, including allowances; the vendor offered a voluntary price reduction resulting in a savings of $12,419 and a revised total contract amount of $512,571. The Broward County Procurement Code, Section 21.30.f.2(c), allows for acceptance of a voluntary reduction after bid opening, if such reduction does not result in the modification or deletion of any condition of the bid.

Transit Division reviewed the bid submitted by Continental Construction USA, LLC and concurs with the recommendation for award (Exhibit 3). Six vendor performance evaluations have been completed for Continental Construction USA, LLC; the firm has a rating of 3.40 out of a possible 5.0.
 
The purchasing agent has reviewed the prices submitted by the recommended bidder, Continental Construction USA, LLC, and has determined that the prices submitted are fair and reasonable when compared to the independent cost estimate (Exhibit 4).
 
There was no protest or appeal filed regarding this procurement.
 
The bid posted on July 12, 2018 and opened on August 22, 2018; five bids were received with no declinations (Exhibit 1).
