MOTION TO APPROVE Fifth Amendment to Mass Transit Transfer Facility Lease between Lauderhill Mall Investment, LLC (Landlord) and Broward County (Tenant) for approximately 37,466 square feet of land and 1,673 square feet of a service building at Lauderhill Mall located at 1267 NW 40th Avenue in the City of Lauderhill, extending the lease for an additional term of five years plus three successive one-year renewal options at an annual rental rate of $4,200; and authorize the Mayor and Clerk to execute same. (Commission District 9)

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND TRANSPORTATION DEPARTMENT/TRANSIT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On March 11, 1997 (Item No. 8), the Board of County Commissioners approved the Mass Transit Transfer Facility Lease for a term of 25 years at Lauderhill Mall which is located at 1267 North State Road 7 in Lauderhill and is identified by Folio Number 4941-36-00-0012. The County leases approximately 37,466 square feet of land and 1,673 square feet of a service building which includes restrooms and lounge for Transit staff and storage space at an annual rental rate of $4,200. The lease, as amended, terminates on February 29, 2019.
 
The Fifth Amendment to the Lease extends the term for an additional five-years effective March 1, 2019 and provides for three one-year renewal options at the same annual rent of $4,200. The County has the right to terminate for convenience upon 60 days written notice to the landlord.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
