MOTION TO APPROVE Revocable License Agreement between Broward County, the City of Margate and TVC Margate Co., LLC for installation and maintenance of landscaping and irrigation along the south side of Copans Road between State Road 7/US 441 and NW 55th Avenue in the City of Margate, at no cost to the County; and authorize Mayor and Clerk to execute same. Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.

Copans Road is a County road located in the City of Margate. TVC Margate Co., LLC and the City of Margate desire to install landscaping and irrigation within County right-of-way along the south side of Copans Road between State Road 7/US 441 and NW 55th Avenue.

The landscaping improvements shall incorporate a minimum 50% native species by plant types and shall follow the Broward County NatureScape program and Florida-Friendly Landscaping principles. TVC Margate Co., LLC will be obligated to maintain these improvements. In the event that TVC Margate Co., LLC fails to maintain the improvements, the City of Margate is obligated to perform the maintenance. The agreement also allows the County to terminate the agreement with or without cause at any time. If the agreement is terminated, TVC Margate Co., LLC must remove all improvements within the licensed right-of-way and restore the property.

The agreement has been reviewed and approved as to form by the County Attorney’s Office and the Risk Management Division.
