MOTION TO AWARD open-end contract to low responsive, responsible bidder, Southern Underground Industries, Inc., a certified County Business Enterprise, for Regional Sewer Air Release Valves, Bid No. PNC2117202B1, for Water and Wastewater Services, in the annual estimated amount of $1,619,905, which includes allowances in the amount of $70,000, and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $4,859,715. The initial contract period shall begin on date of award and will terminate one year from that date, contingent upon receipt and approval of insurance/performance and payment guaranty.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that include a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) designated the project as a reserve opportunity for County Business Enterprises (CBE) firms. Southern Underground Industries, Inc. is a certified CBE firm, which has been reviewed and approved by the OESBD (Exhibit 2). 

The purpose of this procurement is to furnish all labor, materials, equipment and incidentals necessary to install, repair and/or maintain sewer air relief valves, fittings, maintenance access structures and miscellaneous items for and through Broward County Water and Wastewater Services sewer system mains.

The allowances incorporated in this contract, in the annual amount of $70,000, include: $20,000 for non-Broward County permit fees $35,000 for specialty contractor services; and $15,000 for parts and materials. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor's actual costs incurred, without mark-up.

This procurement carries a 25% performance and payment guaranty. The Purchasing Division has confirmed with the surety company that Southern Underground Industries, Inc. has the capacity to obtain the required guaranty.

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. Southern Underground Industries, Inc. has agreed to be bound to the contractual obligations of the Workforce Investment Program.

The Director of Purchasing has determined the apparent low bidder, Southeastern Engineering Contractors, Inc., to be non-responsive to the bid requirements; the bidder was not a certified County Business Enterprise (CBE).

Water and Wastewater Services has reviewed the bid submitted by Southern Underground Industries, Inc. and concurs with the recommendation for award (Exhibit 3). Three final vendor performance evaluations were completed for Southern Underground Industries, Inc.; the firm has an overall rating of 3.94 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.

The prices submitted by Southern Underground Industries, Inc. are fair and reasonable in comparison to the previous Broward County contract (Exhibit 4).

There was no protest or appeal filed regarding this procurement.

Incumbent Vendor: Southern Underground Industries, Inc. Agreement Number and Title: Y1329702B2, Regional Sewer Air Relief Valves. Contract Terms: August 11, 2015 to August 10, 2018. Expenditures to-date: $667,842.

The bid posted on September 10, 2018 and opened on October 10, 2018; two bids were received with no declinations (Exhibit 1).
