MOTION TO ADOPT Resolution No. 2019-057 directing the County Administrator to publish Notice of Public Hearing to be held on February 26, 2019, at 10:00 a.m., to consider transmittal to designated State review agencies of a proposed amendment to the Broward County Land Use Plan text (PCT 19-5), regarding accessory dwelling units, as an amendment to the Broward County Comprehensive Plan.

ACTION:  (T-10:55 AM)  Approved.  

VOTE: 9-0.  Commissioner Geller voted in the affirmative telephonically.

 
Why Action is Necessary
It is necessary to schedule a public hearing of the Broward County Board of County Commissioners prior to transmittal of an amendment to the Broward County Comprehensive Plan.
What Action Accomplishes
The Resolution directs the County Administrator to set a public hearing for February 26, 2019, to consider transmittal of proposed text amendment PCT 19-5, which is an amendment to the Broward County Land Use Plan, to designated State review agencies pursuant to Section 163.3184, Florida Statutes, as amended.

Summary Explanation/Background
The Planning Council, as the Local Planning Agency (LPA) responsible for the Broward County Land Use Plan, considered the following proposed text amendment, PCT 19-5, at its January 24, 2019, public hearing and recommended approval(Vote of the Planning Council; Unanimous: 14-0; Blackwelder, Blattner, Breslau, Brunson, Castillo, DiGiorgio, Good, Graham, Hardin, Rich, Rosenof, Rosenzweig, Williams and Stermer):

AMENDMENT PCT 19-5
Amendment to the Broward County Land Use Plan Text regarding accessory dwelling units.

The Broward County Planning Council initiated the proposed amendment at its October 25, 2018, meeting. The proposed amendment is consistent with the Planning Council and County Commission’s encouragement of incentives for affordable housing opportunities. Accessory Dwelling Units are authorized by Florida Statutes Chapter 163.31771. It is noted that local governments may be more restrictive than the Broward County Land Use Plan.

Further, if the County Commission sets the public hearing, the full amendment report and associated attachments will be included as an exhibit to the public hearing item.
