MOTION TO ADOPT Resolution No. 2019-064 to vacate an 18-foot parking and access easement and partial abandonment of a ten-foot utility easement lying within Parcel A of the East Ridge Office Building Plat, located at 7305 West Sample Road in Coral Springs at no cost to the County; Petitioner: Sample Rock, LLC; Agent: CPH, Inc.; Application for Vacation and Abandonment: 2018-V-10. (Commission District 2)

VOTE: 9-0.  Commissioner Geller voted in the affirmative telephonically.

 
Why Action is Necessary
Board approval is required to vacate utility easements pursuant to Broward County Administrative Code, Chapter 25.
What Action Accomplishes
Provides the property owner, Sample Rock, LLC, with clear unencumbered title to the lands in the areas affected by this vacation.

The Board approved Resolution No. 2019-011 on January 8, 2019 authorizing a public hearing to be held on February 12, 2019 (Item No. 16).
Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL.

The 18-foot parking access easement and partial abandonment of a ten-foot utility easement to be vacated, lying within a portion of Parcel A of the East Ridge Office Building Plat recorded in Plat Book 102, Page 3, are located at 7305 West Sample Road in Coral Springs in Section 14, Township 48 South, Range 41 East (Folio Number 4841-14-11-0010). Vacating these easements will provide clear and unencumbered title to the property owner, Sample Rock, LLC.

The City of Coral Springs approved this vacation by adopting Resolution No. 1217-047 on November 15, 2017. The Petitioner published a Notice of Intent to vacate on January 19, 2018 and January 26, 2018.

The vacation application and fee were received, and the fee was deposited by the Real Property Section on February 16, 2018.

Review of this application by the applicable Broward County agencies and utility companies was completed on November 7, 2018. No reviewing agency has indicated that these easements are currently used or is planned for future use. No objections to this vacation were raised by any of the reviewing agencies.

This vacation application has been reviewed and approved as to form by the County Attorney’s Office.
