In 2017, the Board directed the Office of the County Attorney to seek intervention in an administrative case known as Kanter Real Estate v. Florida Department of Environmental Protection, then pending before the Florida Division of Administrative Hearings. In the case, Kanter challenged the Florida Department of Environmental Protection's proposed denial of an exploratory oil well permit. The Division of Administrative Hearings entered an order recommending issuance of the permit. However, the Department of Environmental Protection issued a final order denying the permit. Kanter appealed this final order.
On February 5, 2019, the First District Court of Appeal issued an opinion reversing the Department's final order and ordering the Department to issue an exploratory oil well permit.
This item will enable a public discussion of options to continue the court challenge and also of the requirements for Kanter to drill an exploratory oil well.
