A. MOTION TO ADOPT budget Resolution No. 2019-046 transferring funds within the Law Enforcement Trust Fund for the Broward Sheriff's Office in the amount of $406,958 for the purpose of supporting the Narcotics Interdiction Task Force in Fiscal Year 2019.

B. MOTION TO ADOPT budget Resolution No. 2019-047 transferring funds within the Law Enforcement Trust Fund for the Broward Sheriff's Office in the amount of $76,544 for the purpose of supporting the Broward County Drug Task Force in Fiscal Year 2019.

ACTION:  (T-10:55 AM)  Approved.  

VOTE: 9-0.  Commissioner Geller voted in the affirmative telephonically.


C. MOTION TO ADOPT budget Resolution No. 2019-048 transferring funds within the Law Enforcement Trust Fund for the Broward Sheriff's Office in the amount of $72,000 for the purpose of supporting the Organized Crime Activities Section Task Force in Fiscal Year 2019.

ACTION:  (T-10:55 AM)  Approved.  

VOTE: 9-0.  Commissioner Geller voted in the affirmative telephonically.

 
D. MOTION TO ADOPT budget Resolution No. 2019-049 transferring funds within the Law Enforcement Trust Fund for the Broward Sheriff's Office in the amount of $1,059,671 for the purpose of supporting the Money Laundering Task Force in Fiscal Year 2019.

ACTION:  (T-10:55 AM)  Approved.  

VOTE: 9-0.  Commissioner Geller voted in the affirmative telephonically.
Why Action is Necessary
Florida Statutes s. 932.7055(5)(a) requires that proceeds from the disposition of liens and forfeited property obtained from criminal procedure and corrections be deposited in a special law enforcement trust fund to be used for law enforcement purposes.

Recommendation of the Sheriff and approval by the Board are necessary to appropriate LETF funds.

A. Provides LETF funding in the amount of $406,958 to support the Narcotics Interdiction Task Force.

B. Provides LETF funding in the amount of $76,544 to support the Broward County Drug Task Force.
 
C. Provides LETF funding in the amount of $72,000 to support the Organized Crime Activities Section Task Force.

Previous Action Taken
A. LETF funds have been appropriated for the Narcotics Interdiction Task Force in fiscal years 2010 to 2014 and 2016 to 2018.  Most recently, the Board approved the appropriation of $177,537 from LETF to support the Narcotics Interdiction Task Force in Fiscal Year 2018 on November 7, 2017. 

B. LETF funds have been appropriated for the Broward County Drug Task Force in fiscal years 2016, 2017, and 2018. Most recently, the Board approved the appropriation of $229,438 from LETF to support the Broward County Drug Task Force in Fiscal Year 2018 on November 7, 2017.

C. LETF funds have been appropriated for the Organized Crime Activities Section Task Force in fiscal years 2015 to 2018. Most recently, the Board approved the appropriation of $87,000 from LETF to support the Narcotics Interdiction Task Force in Fiscal Year 2018 on November 7, 2017.

D. LETF funds have been appropriated for the Money Laundering Task Force in Fiscal Years 2013 to 2018. Most recently, the Board approved the appropriation of $596,000 from LETF to support the Money Laundering Task Force in Fiscal Year 2018 on November 7, 2017.
Summary Explanation/Background
A. The Broward Sheriff's Office administers the Narcotics Interdiction Task Force account for the members of the Task Force. This agreement has been in place as a result of the MOU, in which BSO is an active member along with the other cities that participate. The Task Force MOU stipulates that 20% of the assets seized is returned to the Task Force for operational and administrative costs. Because this is a tenured Task Force, there are many seizures, both state and federal, that are pending forfeiture. The Task Force targets criminal organizations committing criminal acts and makes arrests and seizes assets associated with their criminal activity. The budget for the Narcotics Interdiction Task force is funded 82.4% with local LETF funds and 17.6% with federal LETF funds.

B. The Broward Sheriff's Office supports this LETF request for the operations of the Broward County Drug Task Force (BCDTF). The Task Force targets criminal organizations committing illegal acts, makes arrests, and seizes assets associated with their criminal activity. The Task Force MOU stipulated that 20% of the assets seized is returned to the task force to cover operational and administrative costs. The budget for the Broward County Drug Task Force is funded 11.9% with local LETF funds and 88.1% with federal LETF funds.

C. The Broward Sheriff's Office supports this LETF request for the Organized Crime Activities Section Task Force (OCAS). The OCAS Task Force identifies and targets for prosecution individuals and groups involved in organized crime activity in the South Florida area. In addition, the Task Force also seizes currency and assets associated with the organization's criminal activity. The budget for the Organized Crime Activities Section Task Force is funded 55.6% with local LETF funds and 44.4% with federal LETF funds.

D. The Broward Sheriff's Office supports this LETF request for the Money Laundering Task Force (MLTF). In the Memorandum of Understanding (MOU) BSO is the designated administrator of the MLTF which is composed of BSO, federal agencies, and many of the city police agencies in Broward County. Twenty percent (20%) of funds forfeited as a result of the MLTF investigations (both state and federal) are earmarked for MLTF operations so that the project is self-sustaining. The remaining 80% of the funds are distributed to the agencies that participated. The budget for the Money Laundering Task Force is funded 94.7% with local LETF funds and 5.3% with federal LETF funds.

Fiscal Impact/Cost Summary:
Funds are available within the Law Enforcement Trust Fund for these actions. According to BSO, the current balance of the LETF, as of January 23, 2019, is $5,103,117 in the local account ($3,037,184 of which is unrestricted) and $5,637,760 in the federal account ($2,030,189 of which is unrestricted). These actions will utilize $1,388,470 in local funds and $226,705 in federal funds.
