Why Action is Necessary
Board approval is required to vacate utility easements pursuant to Broward County Administrative Code, Chapter 25.
What Action Accomplishes
Provides the property owner, SWFLB, LLC, with clear unencumbered title to the lands in the areas affected by this vacation.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The platted utility easement measures 2,113 square feet, lying within Parcel B of the Mercury Plat as recorded in Plat Book 154, Page 40 of the Public Records of Broward County and is located at 488 SW 1st Avenue in Fort Lauderdale in Section 10, Township 50 South, Range 42 East (Folio Number 5042-10-1H-0020). Vacating this utility easement will provide clear and unencumbered title to the property owner, SWFLB, LLC.

The City of Fort Lauderdale approved this vacation by adopting Resolution No. 17-150 on July 11, 2017. The Petitioner published Notice of Intent to vacate on January 5, 2018 and January 12, 2018. The vacation application and fee were received, and the fee was deposited by the County's Real Property Section on March 29, 2018.

Review of this application by the applicable Broward County agencies and utility companies was completed on October 19, 2018. The reviewing agencies have indicated that the utility easement is currently unused, and there are no plans for future use. No objections to this vacation were raised by any of the reviewing agencies.

This vacation application has been reviewed and approved as to form by the Office of the County Attorney.
