Requested Action
MOTION TO AWARD open-end contract to low responsive and responsible bidder, Oracle Elevator Company, for Elevator and Escalator Maintenance and Repair Services at Port Everglades, Bid No. BLD2116389B1, in the initial two-year estimated amount of $1,913,800, which includes allowances in the amount of $126,000, and authorize the Director of Purchasing to renew the contract for three one-year periods, for a five-year potential estimated amount of $4,784,500. The initial contract period begins on February 1, 2019 and terminates two years from that date, contingent upon receipt and approval of insurance.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that include a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development did not assign County Business Enterprise (CBE) goals for this procurement, because there are no opportunities for CBE contractors (Exhibit 2).

The purpose of this contract is to provide maintenance and repair services for elevators and escalators located at Port Everglades. All prices, terms and conditions will remain fixed for the initial two-year contract period. Upon completion of the initial contract period, the contractor may make a timely request for an annual price adjustment, prior to the renewal date, for years three through five, in accordance with the price adjustment clause term of the contract.

The pass-thru allowance items included in this contract, in the annual estimated amount of $63,000, include $3,000 for non-County agency permits and fees; and $60,000 for parts, materials and miscellaneous items, that may be required during the course of the contract and are not covered by existing bid items. The contract administrator must approve expenditures under these allowance items, and the County will reimburse the contractor at the contractor's actual incurred cost, without mark-up (Exhibit 1).
 
In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. Oracle Elevator Company agrees to be bound to the contractual obligations of the Workforce Investment Program.

In accordance with the Broward County Living Wage Ordinance, Broward County Administrative Code, Section 26-101 (i), these services are covered services. Oracle Elevator Company has agreed to be bound to the contractual obligations of the Living Wage Ordinance, as amended (Exhibit 6).

The Director of Purchasing determined the low bidder, thyssenkrupp Elevator Company, to be non-responsive for taking exceptions to the solicitation terms and conditions.  The General Conditions of Bid No. BLD2116389B1 reads as follows: “Any material modification of the solicitation and/or any alteration to the verbiage is expressly prohibited and is not enforceable.”

The Port Everglades Department reviewed the bid submitted by Oracle Elevator Company (Oracle) and concurs with the recommendation for award (Exhibit 3). There are no final vendor performance evaluations completed for County agencies for Oracle.  However, a periodic vendor performance evaluation has been completed for the current contract where Oracle is providing services to the County.  Oracle received an overall rating of 3.76 out of a possible rating of 5.0, and the County agency indicated that it would recommend future work to Oracle.  As part of its bid submittal, Oracle provided the City of Sunrise (City) as a reference. Based on the feedback the County received from the City (Exhibit 3 page 2 of 5), follow up inquiries with the City revealed that the City did in fact renew contracts with Oracle, and the City reported there are "no deficiencies on file" for Oracle.  The contracts were renewed consistent with the dates referenced on the attached forms (Exhibit 4). 

The recommended bidder, Oracle Elevator Company, submitted prices determined to be fair and reasonable, and aligned with market analysis for the industry in comparison to the previous Broward County contract and other governmental contracts (Exhibit 5).

There is no protest or appeal filed regarding the procurement.

Interim Contract Term (X1054111X1): July 1, 2018 through January 2, 2019, Expenditures to date: $248,578.5, which includes a purchase order issued to cover services through January 2019.

The bid posted on May 14, 2018 and opened on June 20, 2018; four bids were received with one declination (Exhibit 1).  Bid validity extension from Oracle was secured through January 31, 2019.
