A. MOTION TO APPROVE retroactively U.S. Environmental Protection Agency (EPA) Cooperative Agreement A-00402615 (grant), amendment number 9 in the amount of $418,300, of which the County in-kind match is $293,300, and authorize the County Administrator to execute administrative and budgetary actions to implement the grant and allocate and implement subsequent partial awards under Agreement A-00402615, subject to approval as to form by the County Attorney, in a total additional funding not to exceed $400,000.

MOTION TO ADOPT budget Resolution No. 2019-024 within the US EPA 105 Grant Fund for the Environmental Engineering and Permitting Division in the amount of $418,300 of which $125,000 is EPA funding and $293,300 is Broward County in-kind match, for the purpose of protecting and improving air quality in Broward County.

Why Action is Necessary
Section 125.01(1)p, Florida Statutes authorizes the Board to enter into agreements with other governmental agencies. Board action is required for Agreement approval to accept the grant award, and to recognize the award within the Environmental Protection and Growth Management Department.
What Action Accomplishes
This action provides continued funding for air quality program support in Broward County, and allows for the appropriation of this funding.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL ENGINEERING AND PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

The Environmental Engineering and Permitting Division implements a federally and state approved local air pollution control program responsible for protecting and improving air quality in Broward County. The Air Quality Program is funded in large part by the EPA Section 105 grant (Exhibit 2).

Motion A accepts amendment number 9 and extends the grant period to five years from October 1, 2014 through September 30, 2019. Retroactive approval is being requested because the grant award was not received from EPA until November 20, 2018.

Motion B adopts a budget Resolution for the first partial award under this amendment in the amount of $125,000 and the county in-kind match of $293,300, for a total of $418,300 (Exhibit 3).

The County Air Quality program has been supported by the EPA Section 105 grant for over 20 years. The program includes implementation of the 1990 Clean Air Act Amendments, ambient air monitoring, permitting and compliance verification, asbestos inspections, air quality analysis and planning and public outreach.

Because the County is a recipient of funds from a federal agency under this agreement, the County's standard form agreement provisions are not included. However, this agreement was approved as to form by the Office of the County Attorney.
