Requested Action
MOTION TO ADOPT Resolution No. 2019-002 approving Quit Claim Deed conveying a portion of property located at 920 NW 7th Avenue which is the location of the Central Homeless Assistance Center in Fort Lauderdale to Broward Partnership for the Homeless, Inc. subject to a Declaration of Covenants and Restrictions limiting use of the property for permanent supportive housing for formerly homeless persons and rental housing for individuals earning up to 60% of the area median income and a Parking Easement Agreement granting the County 54 parking spaces for the operation of the Central Homeless Assistance Center; authorize the Mayor and Clerk to execute the Quit Claim Deed and Parking Easement Agreement; and authorize the Real Property Director to take any and all actions to effectuate the transaction. (Commission District 7)

(Per the Tuesday Morning Memorandum, Exhibits 1 and 3 are being replaced.  The prior version of Exhibit 1 was not signed and did not include the signed easement.  At the request of the Office of the County Auditor, language was added to Exhibit 3 to allow the County to audit records related to the property.)


ACTION:  (T-11:20 AM)  Approved as amended with Yellow-Sheeted Additional Material, dated January 8, 2019, submitted at the request of the Office of the County Attorney.

Why Action is Necessary
Board of County Commissioners' approval is required to convey real property and accept an easement pursuant to Broward County Administrative Code, Section 6.23.

Conveys a portion of County-owned real property to Broward Partnership for the Homeless, Inc. subject to a Declaration of Covenants and Restrictions and a Parking Easement Agreement in favor of the County.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Central Homeless Assistance Center (CHAC) is located at 920 NW 7th Avenue in Fort Lauderdale and identified by Folio Number 5042-03-14-0010. The CHAC is currently operated by the Broward Partnership for the Homeless, Inc. (BPHI). BPHI has requested the County convey a portion of the CHAC property for the development and use of multifamily affordable housing with adequate parking.

The conveyance would be subject to a Declaration of Covenants and Restrictions limiting the use of the property for permanent supportive housing for formerly homeless persons and rental housing for individuals earning up to 60% of the area median income. In the event the housing is not constructed within 120 months of conveyance, the property shall revert back to the County. In addition, the conveyance would be subject to a Parking Easement Agreement allowing the County to use 54 parking spaces for the CHAC.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
