MOTION TO AWARD fixed contract to low bidder, Kiewit Infrastructure South Co., for McIntosh Security Checkpoint 4 Modification at Port Everglades, "clean" low Bid No. PNC2116172C1, for Seaport Engineering and Facilities Maintenance Division in the amount of $1,769,675, including $210,000 in allowances, to be substantially completed within 300 calendar days from the Project Initiation Date listed in the Second Notice to Proceed, and authorize the Mayor and Clerk to execute same.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that require two-party agreement execution, based on review by the Office of the County Attorney.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT/SEAPORT ENGINEERING AND FACILITIES MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development did not establish a County Business Enterprise participation goal for this contract (Exhibit 2).

This contract provides for the furnishing of all labor, materials, equipment, services and incidentals for the McIntosh Security Checkpoint 4 Modification at Port Everglades to provide an additional outbound (northbound) lane, increasing the total northbound lanes to three, while maintaining the existing four inbound (southbound) lanes into the Southport section of Port Everglades.

This procurement carries a 100% performance and payment guaranty. The Purchasing Division confirmed with the surety company that Kiewit Infrastructure South Co. has the capacity to obtain the required guaranty.

The allowances incorporated into this contract in the amount of $210,000 include: $50,000 for non-Broward County permit fees; $150,000 for unforeseen underground utilities; and $10,000 for identification badges and security fees. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor's actual cost without mark-up.

Seaport Engineering and Facilities Maintenance Division staff reviewed the bid submitted by Kiewit Infrastructure South Co. and concurs with the recommendation for award (Exhibit 3). No vendor performance evaluations have been completed for Kiewit Infrastructure South Co.

The prices submitted by the recommended bidder, Kiewit Infrastructure South Co., have been reviewed, and it was determined that the prices submitted are fair, reasonable and aligned with market analysis (Exhibit 4).

This was a "clean" low bid as no bidder was determined to be nonresponsive or nonresponsible by the Director of Purchasing, no protests were filed, and more than one bidder submitted a response to this solicitation. The construction agreement is based on competitive bid pricing and is not negotiated. The agreement includes project-specific requirements; however, it includes Broward County's standard terms and conditions.

The Board was notified of recommendation to award on July 9, 2018 through a low bid report.  There were no requests for Board action based on the report; however, the Office of the County Attorney is requiring two-party agreements to be submitted for execution by the Mayor and Clerk.

The bid posted on April 2, 2018 and opened on May 16, 2018; two bids were received with no declination (Exhibit 1).
