MOTION TO APPROVE Revocable License Agreement between Broward County, and Third Avenue Associates, Ltd. for the installation and maintenance of safety barriers along the east side of SE 3rd Avenue north of East Las Olas Boulevard in the City of Fort Lauderdale, at no cost to the County; and authorize Mayor and Clerk to execute same. Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.

SE 3rd Avenue is a County road located in the City of Fort Lauderdale. Third Avenue Associates, Ltd. desires to install and maintain safety barriers within County right-of-way along the east side of SE 3rd Avenue north of East Las Olas Boulevard. Stainless steel bollards will be installed in front of the three windows facing SE 3rd Avenue in the TD Ameritrade building as protection devices to prevent errant vehicles from impacting the building.

The agreement will allow Third Avenue Associates, Ltd. to install and maintain the safety barriers in County right-of-way. The agreement also allows the County to terminate the agreement with or without cause at any time. If the agreement is terminated, Third Avenue Associates, Ltd. must remove all improvements within the right-of-way and restore the property to its original condition. Third Avenue Associates, Ltd. is obligated to secure and maintain a letter of credit in the event sidewalk repairs are necessary due to the installation of the safety barriers.  

The agreement has been reviewed and approved as to form by the County Attorney’s Office and the Risk Management Division.
