MOTION TO ADOPT Resolution No. 2019-001 approving a form Quitclaim Deed to replace a previously approved form Quitclaim Deed for property located at 3490 SW 26th Terrace in Dania Beach to MB-26 Ave, LLC for a purchase price of $7,501,000; authorizing the Mayor and Clerk to execute the Quitclaim Deed and authorizing recordation of same; and to approve the form of Quitclaim Deed for any other properties sold as part of the Interlocal Agreement between the County and the City of Dania Beach, dated November 19, 2013, as needed. (Commission District 7)

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

On October 18, 2016 (Item No. 5), the Board of County Commissioners authorized the sale of certain real properties which are part of the Interlocal Agreement between the County and the City of Dania Beach, dated November 19, 2013.  The agenda item included a form Quitclaim Deed.  Under Florida Statutes, Section 270.11, unless specifically released, a local government entity reserves certain interests in phosphate, minerals, metals, and petroleum in any property it conveys. In addition, the local government entity also has a right of entry and exploration related to such interest.

The proposed purchaser MB-26 Ave LLC has requested the release of the County’s right of entry only under Florida Statutes, Section 270.11 as it relates to the subject property identified by Folio Number 5042-20-52-0080.  This release is necessary for the purchaser to obtain a loan to purchase the property. The replacement form Quitclaim Deed releases the County’s right of entry; however, it does not affect the County’s rights to the phosphates, minerals, metals, and petroleum under the statute.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
