MOTION TO APPROVE revised Fourth Amendment to Interlocal Agreement for Creation of the Broward County Metropolitan Planning Organization ("Fourth Amendment"), in substantially the same form as attached hereto, and subject to approval by the Office of the County Attorney as to legal sufficiency. (Commissioner Furr)

Board approval is necessary to amend the provisions of the previously approved proposed Fourth Amendment.

Approves the Fourth Amendment in substantially the same form as previously approved by the Board but extending the deadline for execution by all the parties until July 1, 2019.

Summary Explanation/Background
On June 12, 2018, Agenda Item No. 82, the Board approved the Fourth Amendment, modifying the County Commission membership on the Metropolitan Planning Organization (MPO). Section 5 of the Fourth Amendment provides that it will become effective upon execution by the membership of MPO, on or before December 31, 2018. After consideration of the Fourth Amendment at its meeting of November 14, 2018, the MPO directed its counsel to draft amendments to its Bylaws addressing voting procedures and stated that it will consider the Fourth Amendment after said amendments are completed.

As a result, it is necessary to extend the deadline for the parties to execute the Fourth Amendment. The attached revised Fourth Amendment extends the deadline to July 1, 2019. If approved, the revised Fourth Amendment will supersede the one previously approved by the Board on June 12, 2018.
