MOTION TO RETROACTIVELY APPROVE Agreement between Broward County and the State of Florida Department of Health (DOH) in the amount of $1,827,864 from October 1, 2018, through September 30, 2019, to provide public health services to Broward County residents; authorizing the Mayor and Clerk to execute the Agreement; authorizing the County Administrator to execute amendments to the agreement subject to approval of the amendments by the County Attorney; authorizing the County Administrator to take the necessary administrative and budgetary actions to implement the Agreement.

Why Action is Necessary
Chapter 154.001, Florida Statutes, requires that the County enter into a contractual arrangement with the DOH to meet the public health needs of the state through a system of coordinated county health department services. In accordance with the Broward County Administrative Code Section 23.7, all contracts with external agencies must be approved by the Board of County Commissioners.

Broward County contributes to the County Health Department (CHD) Trust Fund to locally promote, protect, maintain, and improve the health and safety of Broward County's residents and visitors, as well as fulfill the County's statutory obligation to provide annual funding.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This action supports the Board’s Value of “[A]pproaching human services collaboratively and compassionately, with special emphasis on the most vulnerable,” and the Goal to “[E]ffectively advocate for and acquire municipal, state and federal financial support to equitably address health and human services needs of the entire community, through a truly coordinated system of care.” The Agreement enhances the public's health; controls and eradicates preventable diseases, and; provides primary health care for special populations.

Retroactive approval is requested as Broward County did not receive the Fiscal Year 2018-2019 Core Operating Agreement for review until August 29, 2018. Following receipt of requested revisions, The Florida Department of Health (DOH) finalized the Agreement on November 6, 2018.

In accordance with Section 154.001 and 154.07, Florida Statutes (F.S.), Broward County provides annual funding to the County Health Department ("CHD") Trust Fund, which was established in 1931. This Agreement fulfills that obligation and enables the DOH to promote and improve the health and safety of Broward County residents by providing environmental health, communicable disease control, and primary care services. The total Fiscal Year 2019 budget for DOH-CHD is $36,629,446; including Broward County funding totaling $1,827,864. In addition to this financial contribution, Broward County provides DOH use of seven facilities, valued at $2,693,816, where DOH-CHD provides services (Exhibit 2 Attachment IV).

The DOH establishes outcome measures on an annual basis. All Fiscal Year 2017-2018 outcomes were met. The Fiscal Year 2019 performance outcomes remain the same and are listed in Exhibit 2, Attachment VIII of the Agreement. The source of DOH's contributions, including Broward County's, is noted in Attachment II, Part II of the Agreement. The CHD Trust Fund ledger is separated into State and County Funding at the start of each State Fiscal Year. Any revenue not derived from the State is accounted for on the County side of the ledger. This does not obligate Broward County to any additional funding beyond the appropriated $1,827,864.

The Agreement has been reviewed and approved as to form by the Office of the County Attorney. The Agreement is in the State's format; thus DOH will sign last.
