THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development did not assign County Business Enterprise (CBE) goals for this procurement, because there are no opportunities for CBE contractors (Exhibit 2).
The purpose of this contract is to provide maintenance and repair services for elevators and escalators located at Port Everglades. All prices, terms and conditions will remain fixed for the initial two-year contract period. Upon completion of the initial contract period, the contractor may make a timely request for an annual price adjustment, prior to the renewal date, for years three through five, in accordance with the price adjustment clause term of the contract.
The pass-thru allowance items included in this contract, in the annual estimated amount of $63,000, include $3,000 for non-County agency permits and fees; and $60,000 for parts, materials and miscellaneous items, that may be required during the course of the contract and are not covered by existing bid items. The contract administrator must approve expenditures under these allowance items, and the County will reimburse the contractor at the contractor's actual incurred cost, without mark-up (Exhibit 1).
In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.21, these services are subject to the Workforce Investment Program. Oracle Elevator Company agrees to be bound to the contractual obligations of the Workforce Investment Program.
In accordance with the Broward County Living Wage Ordinance, Broward County Administrative Code, Section 26-101 (i), these services are covered services. Oracle Elevator Company has agreed to be bound to the contractual obligations of the Living Wage Ordinance.
The Director of Purchasing has determined the low bidder, thyssenkrupp Elevator Company, to be non-responsive for taking exceptions to the solicitation terms and conditions pursuant to the Broward County Procurement Code, Section 21.30.f.3 (b). General Conditions of the solicitation reads, “Any material modification of the solicitation and/or any alteration to the verbiage is expressly prohibited and is not enforceable.”
The Port Everglades Department reviewed the bid submitted by Oracle Elevator Company and concurs with the recommendation for award (Exhibit 3). No vendor performance evaluations were completed for Oracle Elevator Company.
The recommended bidder, Oracle Elevator Company, submitted prices determined to be fair and reasonable, and aligned with market analysis for the industry in comparison to the previous Broward County contract and other governmental contracts (Exhibit 4).
There is no protest or appeal filed regarding the procurement.
