Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.

Copans Road is a County road located in the City of Margate. TVC Margate Co. desires to install drainage facilities within a 15-foot-by-592-foot area of County right-of-way along the south side of Copans Road approximately 580 feet east of State Road 7/U.S. 441.

TVC Margate Co. is developing parcels of land at the southeast corner of Copans Road and State Road 7. This property historically utilized County right-of-way along Copans Road to convey their storm water runoff to an outfall. TVC Margate Co. desires to construct and maintain a separate drainage pipe in County right-of-way for its property, consistent with its historical use. This improvement provides for proper drainage of the property while not impacting the County’s use of the right-of-way.

The agreement will allow TVC Margate Co. to install, operate and maintain drainage facilities within County right-of-way. If necessary for future improvement of Copans Road, the agreement also allows the County to require TVC Margate Co. to adjust or relocate the drainage facilities and restore the area to its original condition.

The agreement has been reviewed and approved as to form by the County Attorney’s Office and the Risk Management Division.
