MOTION TO APPROVE First Amendment to Work Authorization No. 012FMD in accordance with the Agreement between Broward County and EAC Consulting, Inc. for Comprehensive Professional Engineering Consultant Services, Request for Letter of Interest No. R0911701R1, to provide additional architectural and engineering services for the Ron Cochran Public Safety Complex Fire Alarm System Upgrade, in the amount of $63,354 and reimbursable expenses in the amount of $1,200, for a total amount of $64,554, increasing the total Work Authorization from $92,039 to $156,593; to increase the time for performance by 515 days for a total time of performance of 1,048 days; and authorize the Mayor and Clerk to execute same. (Commission District 9)

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT / CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development established a cumulative County Business Enterprise (CBE) goal of 20% for the term of the Agreement. The vendor has committed to 20% CBE participation. EAC Consulting, Inc. has been paid $668,067 with $241,530 paid to CBE firms, yielding 36.21% participation to date.

On February 28, 2012 (Item No. 58), the Board of County Commissioners approved the Agreement between Broward County and EAC Consulting, Inc. for Comprehensive Professional Engineering Consultant Services, Request for Letters of Interest No. R0911701R1, for a not-to-exceed amount of $1,000,000 per year for two years from the date of the executed Agreement, with three one-year extensions which may be executed under the authority of the Director of Purchasing for a total not-to-exceed five-year amount of $5,000,000.

On April 30, 2013, the Contract Administrator approved the First Amendment to the Agreement to add Hardesty and Hanover, LLC as a subconsultant for Draw Bridge Design Services.

On March 7, 2014, the Contract Administrator under the authority of the Purchasing Director, approved the first renewal of the Agreement for a one-year term, commencing February 28, 2014 and ending February 28, 2015.

On July 15, 2015, the Contract Administrator under the authority of the Purchasing Director, approved the second renewal of the Agreement for a one-year term, commencing February 28, 2015 and ending February 28, 2016.

On September 2, 2016, the Contract Administrator under the authority of the Purchasing Director, approved the third and final renewal of the Agreement for a one-year term, commencing February 28, 2016 and ending February 28, 2017.

On February 24, 2017, the Director of Purchasing approved Work Authorization No. 012FMD for professional architectural and engineering services for replacement of the existing fire alarm system for the Ron Cochran Public Safety Complex, including the main building and associated satellite buildings, with a new addressable fire alarm system in the amount of $92,039.

This proposed First Amendment to Work Authorization No. 012FMD revises and updates the construction documents and specifications to incorporate changes to existing conditions, incorporate new Florida Building Code provisions as well as prepare them for competitive bidding. This amendment authorizes funding for professional architectural and engineering consulting services for the Bidding and Award Phase, Construction Phase and Warranty Phase of the work. 

Negotiation meetings for this First Amendment were held on June 7, 2018, June 20, 2018, and August 8, 2018 and were attended by Broward County staff, representatives from EAC Consulting, Inc. and its subconsultants. As a result of the final negotiation meeting on August 8, 2018, EAC Consulting, Inc. submitted a final proposal, dated September 18, 2018.

The amounts referenced in this agenda item have been rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount (or the maximum amount payable under this work authorization).

This Amendment has been reviewed and approved as to form by the Office of the County Attorney.
