MOTION TO CONSIDER enactment of an Ordinance, the title of which is as follows:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE MEDICAL MARIJUANA ADVISORY BOARD ("MMAB"); AMENDING SECTION 1-311 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); PROVIDING QUORUM REQUIREMENTS FOR THE MMAB; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of November 13, 2018.

Summary Explanation/Background
Section 1-310 of the Broward County Code of Ordinances ("Code") establishes a twelve (12) member Medical Marijuana Advisory Board ("MMAB"), consisting of one (1) categorical appointment by each of the nine (9) Broward County Commissioners and three (3) at large appointments. Section 1-311(d) of the Code provides that a majority of the total membership of the MMAB, or seven (7) members, constitutes a quorum.

As of October 2018, the MMAB only has eight (8) appointed members, due to the difficulty in filling some appointment categories. In some instances, MMAB members have had previous commitments, and meetings have had to be cancelled due to an insufficient number of members being available to constitute a quorum.

The proposed Ordinance amends Section 1-311(d) to provide that a majority of the appointed members of the MMAB constitutes a quorum. This language is consistent with Section 1-233 of the Code, applicable to advisory boards generally.
