MOTION TO CONSIDER APPROVAL of New Findings of Adequacy for a plat entitled BF Pompano Plat (013-MP-10). (Commission District 4)

ACTION:  (T-10:48 AM)  Approved the plat subject to staff’s recommendations as outlined in the Development Review Report.

VOTE:  9-0.
Why Action is Necessary
Findings of adequacy for plats approved pursuant to Chapter 5, Article IX of the Broward County Code of Ordinances (The Broward County Land Development Code) expire five years from the approval date. New findings of adequacy must be approved by the Board of County Commissioners before a building permit can be issued.
What Action Accomplishes
Approves findings of adequacy for another five years for the plat, subject to staff recommendations and conditions assuring compliance with the standards and requirements of the Broward County Land Development Code.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL, subject to staff recommendations and conditions which will assure compliance with the standards and requirements of Chapter 5, Article IX of the Broward County Code of Ordinances.

The applicant is requesting approval of an application for new findings of adequacy, to amend the plat note to develop 239 high-rise units and 14 boat slips, and to amend the non-vehicular access lines (NVAL) on approximately 4.4 acres located on both sides of AIA, north of Terra Mar Drive, in the City of Pompano Beach. The amended NVAL creates one new opening and relocates and modifies the widths of the three existing access openings along State Road A1A. The plat was approved on March 29, 2011, for 396 hotel rooms and 10 existing boat slips. The property remains vacant and the findings of adequacy expired on March 29, 2016. The proposed dwelling units are not subject to Policy 2.16.2 regarding affordable housing, as the proposed use is vested in the Broward County Land Use Plan. See attached Development Review Report.
