Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

Broward County sold a parcel of land located  at Ravenswood Road and SW 39th Street in Dania Beach and identified by Folio Number 5042-29-09-0350 to 811 LLC in August 2017. The parcel was originally acquired by the County using grant funds received from the Federal Aviation Administration (FAA) and the Florida Department of Transportation (FDOT) for use by the Aviation Department. The parcel was acquired to ensure that the future uses of the property were compatible with the operations of the airport and in compliance with FAA requirements which required the County protect the aerial approaches to the airport to prevent the creation of airport hazards.

When the County sold the parcel to 811 LLC, it was subject to a Declaration of Covenants, Restrictions, and Easements as recorded in Official Records Book Instrument No. 114589123 of the Public Records of Broward County (Original DRC). The Original DRC placed certain height restrictions on any improvements and structures located or constructed on the property. Pursuant to the provisions set forth in the Original DRC, the Owner has requested to increase the height restrictions. The FAA has issued a Determination of No Hazard to Air Navigation and has no objections to the increased height restrictions.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
