PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL
On June 12, 2012 (Item No. 7), the Board of County Commissioners approved the County Incentive Grant Program (CIGP) Agreement for improvements to College Avenue from Nova Drive to SR 84. The project was a cooperative effort among the Florida Department of Transportation (FDOT), the Town of Davie (Town) and Broward County. College Avenue is under the jurisdiction of the Town. The project will widen the existing roadway from three to four lanes and includes sidewalks, drainage, lighting, ADA upgrades, bike lanes, landscaping and irrigation. Under the Agreement, FDOT and the Town will each fund 50% of the project. The County has no financial obligation on this project and is only included in the agreement because the grant program requires County involvement in order for the Town to receive funding. This agreement also assigns all of the County’s interest, rights and obligations, financial and otherwise, in the oversight and management of the project to the Town. The Town will be responsible for all future maintenance of this roadway.
The above agreement was not implemented by FDOT upon the Town's request due to updated project cost estimates exceeding the available Town budget. Once adequate funding became available, the Town re-applied for a new grant to improve College Avenue from Nova Drive to SR 84. FDOT agreed to issue a new grant and provided the associated Agreement (Exhibit 1). Motion A will provide CIGP funding to improve College Avenue from Nova Drive to SR 84. Under the proposed agreement, FDOT will fund 50% of the estimated construction cost of $5,201,358, up to a maximum participation amount of $2,600,679. The Town will fund the remaining cost of the project. As in the previous agreement, the County is only included because the grant program requires County involvement in order for the Town to receive funding. This agreement assigns all of the County’s interest, rights and obligations, financial and otherwise, in the oversight and management of the project to the Town. The Town will continue to be responsible for all future maintenance of this roadway.
Motion B will allow the Director of Highway Construction and Engineering Division to timely approve and execute amendments to the agreement with FDOT and the Town of Davie. This authority would be limited to extending the expiration date or revising the standards and specifications, and provided that the amendment would not result in any cost to the County. This delegation of authority will streamline any amendment needed due to unforeseen procurement or construction conditions.
The agreement has been reviewed and approved as to form by the County Attorney's Office and the Risk Management Division.
