MOTION TO APPROVE Second Amendment to Broward County P25 System and Services Master Agreement with Motorola Solutions, Inc., Agreement No. R1422515P1_1, to allow for the purchase of subscriber radio units as Optional Services, including for Broward Sheriff's Office Regional Assets, Aviation, Port, Manatee Patrol and spares, in the additional amount of $10,097,000, for a revised not-to-exceed total contract amount of $73,697,000; and authorize the Mayor and Clerk to execute the same.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.94.a, any changes, including amendments to agreements must be approved by the appropriate award authority, based on the amendment amount.

Previous Action Taken
On February 7, 2017, the Broward County Board of Commissioners approved Motorola as the first ranked vendor in the Request for Proposal R1422515P1 for the P25 Public Safety Radio System and Microwave replacement, and authorized to start negotiations with the vendor.

On May 23, 2017, the Broward County Board of Commissioners approved the agreement between Motorola Solutions, Inc. and Broward County to build an APCO P25 Phase II 700MHz Public Safety Radio System.

On June 28, 2018, the County Administrator executed the First Amendment to the Agreement, increasing the total not-to-exceed amount from $59,500,000 to $63,600,000, modifying the master site and adding certain equipment, among other changes.
Summary Explanation/Background
THE DEPARTMENT OF REGIONAL EMERGENCY SERVICES AND COMMUNICATIONS RECOMMENDS THE APPROVAL OF THE ABOVE MOTION.

Section 5.6 of the original executed agreement made provisions for certain "Eligible Purchasers" (including the Broward Sheriff's Office and municipalities) to purchase subscriber equipment and associated maintenance services under the terms and conditions of the Agreement, under the condition that financial responsibility for the purchase is borne solely by the purchasing entity.

This proposed Second Amendment (Exhibit 2) clarifies that Broward County may also purchase subscriber equipment and associated maintenance services under the Agreement. In addition, this Amendment provides an additional not-to-exceed amount specifically applicable to County’s subscriber equipment purchases, and to include the support and maintenance costs for County subscriber equipment within the not-to-exceed amount for support and maintenance.

Motorola has proposed that no payments and no interest will be assessed to the County until May 2019 if a contract for the purchase of subscriber units is executed by November 15, 2018; please see Exhibit 3. It is the intention of the County to accept Motorola's proposal.

Fiscal Impact/Cost Summary:
Each individual agency (Airport, Port and Manatee Patrol) will fund their respective equipment purchases. The remaining funds for the regional radio use have been previously budgeted.
