A. MOTION TO APPROVE Agreement between Broward County and RS&H, Inc., for Continuing Engineering Services for Transportation and General Civil Engineering Projects, Request for Proposals (RFP) No. PNC2114364P1, for an initial three-year term, in the maximum not-to-exceed amount of $1,000,000 annually, and authorize the Director of Purchasing to execute individual Work Authorizations in amounts up to $500,000, and renew the Agreement for two one-year periods, for a five-year maximum not-to-exceed amount of $5,000,000; and authorize the Mayor and Clerk to execute same. The initial term of the Agreement will begin upon the date of execution and terminate three years from that date.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS. 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) participation goal of 21% for this project. RS&H, Inc. committed to 30% CBE participation and HDR Engineering, Inc. committed to 21% CBE participation, which OESBD reviewed and approved (Exhibit 5).

These Agreements resulted from a Consultants' Competitive Negotiation Act (CCNA) solicitation, which provided for the services of two qualified firms to provide continuing engineering services for transportation and general civil engineering projects, including all necessary engineering specialties for the design, construction and construction management of these projects. Each individual construction projects' estimated cost must be less than $2 million to be processed under these agreement(s), in accordance with CCNA. Work Authorizations under these Agreements will be approved in accordance with Article 4.1 in the Agreement.

On December 5, 2017 (Item No. 56), the Board approved Request for Proposals (RFP) No. PNC2114364P1, Continuing Engineering Services for Transportation and General Civil Engineering Projects. The RFP was advertised and at the time of the opening deadline, 5:00 p.m. on January 10, 2018, four firms submitted proposals.

On March 15, 2018, an Initial Evaluation Committee meeting was held, and the Evaluation Committee determined that all four firms were both responsive and responsible to the RFP requirements.

On April 16, 2018, a Final Evaluation Committee meeting was held. After presentations, the Evaluation Committee decided that two firms would be selected to provide the RFP services. After evaluation, scoring and ranking, the Evaluation Committee selected RS&H, Inc. as the first-ranked firm and HDR Engineering, Inc. as the second-ranked firm.

On May 8, 2018 (Item No. 49), the Board approved the Evaluation Committee's final ranking of the qualified firms and authorized staff to proceed with negotiations.

Three Sunshine meetings were held with RS&H, Inc. to negotiate this Agreement: June 6, June 26 and July 17, 2018. These meetings were attended by representatives of RS&H, Inc., the Highway Construction and Engineering Division and the Purchasing Division.

Three Sunshine meetings were held with HDR Engineering, Inc. to negotiate this Agreement: June 7, June 27 and July 17, 2018. These meetings were attended by representatives of HDR Engineering, Inc., the Highway Construction and Engineering Division and the Purchasing Division.

Funding for each work authorization will be obtained from the appropriate source at the time of release in the annual not-to-exceed amount of $1,000,000 for each agreement, and the five-year total not-to-exceed amount of $5,000,000 for each agreement.
