MOTION TO AWARD open-end contract to single bidder, Clean Harbors Environmental Services, Inc., for Household Hazardous Waste Collection and Disposal, Bid No. OPN2116905B1, for the Solid Waste and Recycling Services Division, in the annual estimated amount of $437,679, and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $1,313,037. The initial contract period shall begin on November 6, 2018 and terminate one year from that date.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that include a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/SOLID WASTE AND RECYCLING SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board's Value, "Encouraging investments in renewable energy, sustainable practices and environmental protection".

The Office of Economic and Small Business Development did not reserve this project for Small Business Enterprises under the Sheltered Market Program, or assign County Business Enterprise (CBE) participation goals to this solicitation, based on the review of services requested (Exhibit 2).

The purpose of this contract is to provide for the collection and disposal of hazardous waste for the County’s residential Household Hazardous Waste Program.

The Solid Waste and Recycling Services Division has reviewed the bid submitted by Clean Harbors Environmental Services, Inc. and concurs with the recommendation for award (Exhibit 3). One vendor performance evaluation was completed for Clean Harbors Environmental Services, Inc.; the firm has a rating of 4.95 out of a possible 5.0. Copies of the vendor performance evaluation are available upon request.

The Purchasing Division researched the prices submitted by the single bidder, Clean Harbors Environmental Services, Inc., and has determined that the prices submitted are fair and reasonable based upon a comparison to the current contract. (Exhibit 4).

The initial bid submitted by Clean Harbors Environmental Services, Inc. was $472,479; the vendor offered a voluntary price reduction for Line Item 49, from $15 to $10 each for Propane Tanks 1 lb.; Line Item 50, from $35 to $25 each for Propane Tanks 20 lb.; Line Item 51, from $135 to $55 each for Propane Tanks over 20 lbs.; and for Line Item 52, from $25 to $2.75 per pound for Refrigerant Gasses All Types in Original Containers, resulting in an overall savings of $34,800 (or 7.4%) and a revised total estimated annual amount of $437,679. The Broward County Procurement Code, Section 21.30.f.2(c), allows for acceptance of a voluntary reduction after bid opening, if such reduction is not conditioned on, nor results in, the modification or deletion of any condition of the bid.

Incumbent: Clean Harbors Environmental Services, Inc., Contract Number and Title: G1091902B1, Household Hazardous Waste Collection and Disposal. Contract Term: August 6, 2013, to November 5, 2018. Expenditures to date: $1,437,123.

Prior to the original bid submission deadline of August 8, 2018, vendor outreach was conducted to increase the number of bid responses. The solicitation advertisement period was extended by five days to August 13, 2018; however, the extension yielded no additional bidders.

The bid posted on July 19, 2018 and opened on August 13, 2018; one bid was received with no declinations (Exhibit 1).

There was no protest or appeal filed regarding this procurement.
