Summary Explanation/Background
State Beach Management (Part of the 2018 Legislative Program as the fifth top Board priority, Page 3 of Exhibit 1)
SUPPORT legislation which updates the State Beach Management Program’s project review criteria to include consideration of a project’s economic and environmental importance and obtain a dedicated state funding source of $50 million per year. The program is updated each year.

Last year the Board directed staff to provide a list of issues so that each Commissioner would rank five main priority issues for a truncated 2018 Program.  Staff tallied the priority rankings of each Commissioner and presented the list of the five highest ranked priorities. Ultimately, the Board added a sixth priority and the Board adopted the following list in order of importance:
  • Affordable Housing
  • Nursing Home Regulation
  • Prohibition of Oil and Gas Drilling
  • Criminal Justice Reform
  • State Beach Management
  • Opioid and Heroin Abuse

As referenced, the 2018 State Legislative Program is attached as Exhibit 1. This includes a number of department, division, and office proposals from within the County, including appropriations requests.

Intergovernmental Affairs/Boards Section (IABS) is seeking direction from the Board in developing the State Program for the 2019 Legislative Session. IABS staff will meet with each Commissioner prior to the October 23, 2018 Commission Meeting to discuss the proposed priorities and afford Commissioners an opportunity to identify any additional issues. Subsequently, staff will provide a conceptual draft of a program that will be submitted as additional material prior to the meeting that would reflect the individual direction provided to staff for review and consideration by the Board.

The following is a list of issues staff has identified that may be of importance to Broward County during the 2019 Legislative Session in alphabetical order:

Affordable Housing (Part of the 2018 Legislative Program as the top Board priority, Page 2 of Exhibit 1)
SUPPORT full funding of the Sadowski Trust Fund and SUPPORT of a local discretionary surtax for affordable housing.

Autopsy Records (Part of the 2018 Legislative Program as a department proposal, Page 15 of Exhibit 1)
SUPPORT a public records exemption for autopsy records of a deceased person for ten days or after law enforcement notifies a surviving spouse, parent, legal guardian, or adult child of the deceased.

Coral Reefs (Part of the 2018 Legislative Program as a policy, Page 5 of Exhibit 1)
SUPPORT increased and continued funding for the coral reef water quality monitoring.

Criminal Justice Reform (Part of the 2018 Legislative Program as the fourth top Board priority, Page 2 of Exhibit 1)
SUPPORT legislation allowing law enforcement discretion when provided an option to issue a person a report or issue a civil citation when the child fails to comply with assigned intervention services. SUPPORT automatic restoration of civil rights, specifically voting rights, to individuals convicted of committing a felony after release from prison and successful completion of any applicable probationary period (Subject to Amendment 4). SUPPORT funding for de-escalation and crisis intervention training for law enforcement officers. SUPPORT funding for organization providing reentry programs.

Drug Take-Back Program (New)
SUPPORT implementation of a statewide drug take-back system funded by pharmaceutical companies as a prevention strategy to reduce prescription drug abuse and addiction. 

Implementation of Constitutional Amendments (New)
SUPPORT/OPPOSE legislation implementing constitutional amendments that may or may not impede home rule authority (Subject to which Amendments are passed).

Needle Exchange Program (Part of the 2018 Legislative Program as a department proposal, Page 15 of Exhibit 1)
SUPPORT expansion of the needle exchange pilot statewide.

Opioid Task Force (New)
SUPPORT a statewide initiative to create an opioid taskforce with stakeholders from local, state and federal agencies, elected officials and community leaders.

Prohibition of Oil or Gas Drilling (Part of the 2018 Legislative Program as the third top Board priority, Page 2 of Exhibit 1)
SUPPORT legislation banning oil or gas drilling and OPPOSE preemption of local regulation of extreme well stimulation. (Subject to Amendment 9).

Reclaimed Water and Reuse (Part of the 2018 Legislative Program as an appropriation, Page 9 of Exhibit 1)
SUPPORT for state funding for reclaimed water and reuse.

Resilience and Sea Level Rise (New)
SUPPORT the development of a Florida Resiliency Plan including collaboration among regional coalitions focused on resiliency and climate change in order to maximize resources, share information, analysis, and best practices, and foster useful collaboration.

School Resource Officers (New)
SUPPORT funding for School Resource Officers in our school system and SUPPORT the recommendations of the Marjory Stoneman Douglas Public Safety Commission where they are applicable to county initiatives.

Septic to Sewer Conversions (New)
SUPPORT state funding for septic to sewer conversion efforts.

Texting While Driving (Part of the 2018 Legislative Program as a policy, Page 6 of Exhibit 1)
SUPPORT legislation making texting while driving a primary offense.

Towing (New)
OPPOSE any efforts to prohibit a county from enacting a rule or ordinance that imposes a fee or license on wrecker and towing operators.

Vacation Rentals (New)
OPPOSE preemption of home rule on the regulation and control of vacation rental properties.
