Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.

NE 3rd Avenue is a County road located in the City of Fort Lauderdale. 400 N.E. 3rd Avenue, LLC and the City of Fort Lauderdale desire to improve a portion of the County right-of-way along the east side of NE 3rd Avenue north of NE 4th Street.

The proposed improvements include installation of landscaping, irrigation, pavers and decorative pedestrian lighting. 400 N.E. Third Avenue, LLC will be obligated to maintain these improvements. In the event that 400 N.E. Third Avenue, LLC fails to maintain the improvements, the City of Fort Lauderdale is obligated to perform the maintenance. The agreement also allows the County to terminate the agreement with or without cause at any time. If the agreement is terminated, 400 N.E. Third Avenue, LLC must remove all improvements within the licensed right-of-way and restore the property.

The City of Fort Lauderdale and 400 N.E. Third Avenue, LLC submitted all necessary documentation required by the Office of the County Attorney in September 2018 and this agreement is now ready for the Board of County Commissioners’ consideration.

The agreement has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
