A. MOTION TO ADOPT Resolution No. 2018-450 of the Board of County Commissioners of Broward County, Florida, authorizing Fiscal Year 2018-2019 appropriation and disbursement of Florida Department of Law Enforcement ("FDLE") Edward Byrne Memorial Justice Assistance Grant ("Byrne JAG") funds to service providers in the amount of $612,489 and Broward County funds in the amount of $53,582 for a total amount of $666,071; authorizing the County Administrator to execute grant agreements with FDLE upon receipt; authorizing the County Administrator to execute the service providers' agreements and to take all necessary administrative or budgetary actions to implement the agreements; and providing for severability and an effective date.

B. MOTION TO ADOPT budget Resolution No. 2018-451 of the Board of County Commissioners of Broward County, Florida providing revenue within the Edward Byrne Grant Fund in the amount of $666,071, commencing November 1, 2018 through September 30, 2019 for the purpose of providing support services to youth.

C. MOTION TO APPROVE waivers of conflict under Section 112.313(7)(a), Florida Statutes for the following Broward County advisory board members holding an employment or contractual relationship with an entity receiving funds for the performance of services under this agenda item:

  3. Valery V. Moreno

Why Action is Necessary
A. Broward County Administrative Code Section 23.7 requires Board approval for appropriation and disbursement of funds to external agencies as well as Resolutions authorizing the County Administrator to execute appropriate agreements and amendments.

B. Florida Statutes Chapter 129.06(2)(d) requires Board approval to recognize revenue.

C. Under Section 112.313(12), Florida Statutes, waivers of conflicts require two-thirds approval by the Board.
What Action Accomplishes
A. and B. These actions provide funding for counseling services including treatment, education and employability training for at-risk Broward County youth with behavioral health issues to reduce the occurrence of alcohol- and drug-related violence and crime.

C. Approval of this motion waives the existence of any conflicts arising under Section112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

These actions support the Board’s Value of “[A]pproaching human services collaboratively and compassionately, with special emphasis on the most vulnerable," and the Goal to “[E]ffectively advocate for and acquire municipal, state and federal financial support to equitably address health and human services needs of the entire community, through a truly coordinated system of care." FDLE funding allows the County to address the behavioral health and employability needs of vulnerable youth.

Broward County is the designated sub-grantee implementing Byrne JAG funding (Exhibit 9). This agenda is requesting Board approval to re-purpose unutilized funds from projects previously approved by FDLE, as wll as funding of a new project. Byrne JAG project funding amounts are identified on Exhibit 1, Attachment A.

Re-purposed funds
On October 25, 2016 (Item No. 14), the Board of County Commissioners of Broward County, Florida ("Board") approved the authorization and disbursement of Byrne JAG funds in the amount of $438,068 during County Fiscal Year 2016-2017 to provide behavioral health counseling to youth at-risk of involvement with the Juvenile Justice system. At the end of that Fiscal Year, the County had unexpended Byrne JAG funds in the amount of $195,797. On May 10, 2018, FDLE allowed the County to re-purpose those funds for behavioral health counseling in response to the tragic Marjory Stoneman Douglas event (Exhibit 3).

The Byrne JAG re-purposed funding of $165,468 will be provided through an amendment to an agreement between the County and the South Broward Hospital District d/b/a/ Memorial Healthcare System ("Memorial"), approved by the Board on September 13, 2018 (Item No. 5). The remaining $30,329 is being used for Planning Evaluation and Technology Improvements ("PETI"), for a total project amount of $195,797, effective November 1, 2018 (Exhibit 1, Attachment A). These funds are available until September 30, 2019.

New funds
On May 1, 2017 Broward County Human Services Department issued a Request For Proposal for workforce development, employability skills training and job coaching services for high-risk youth with behavioral health problems. The review and rating process included participation from community representatives of not-for-profit organizations, government entities, and County staff. Two agencies applied and the highest ranked agency, Helping Abused Neglected Disadvantaged Youth, Inc. ("HANDY") was recommended for inclusion with the County's Byrne JAG application to FDLE for the 2017-2018 County Fiscal Year. The County’s billing agreement period with the recommended agency was intended to commence January 1, 2018. Due to delays at the federal level, the Byrne JAG funding was not released by FDLE and the funding was not issued to HANDY.

On July 19, 2018, FDLE advised the County of the receipt of the federal award (Exhibit 6). This notice includes funds for HANDY in the amount of $383,266 and PETI funds retained by the County in the amount of $33,426, for a total project amount of $416,692 (Exhibit 1, Attachment A). PETI funds are used to fund one staff position that manages all aspects of the grant, ensure compliance with all requirements, data entry and oversight of the project as well as planning and evaluation activities. County funds from the Fiscal Year 2019 Children’s Services Administration Section ("CSAS") approved budget in the amount of $53,582 will be used to support staff salary, benefits and eligible expenses not funded by FDLE (Exhibit 7). On September 7, 2018 FDLE notified the County of the Governor's acceptance of the federal funds (Exhibit 8).

The total amount of both projects, including funds contributed by the County, is $666,071. The Memorial amendment and the HANDY agreement will include FDLE performance measures. The amendment to the Memorial Agreement will be approved by the Office of the County Attorney prior to execution by the County Administrator. The County will utilize the standard form agreement approved by the Board on September 13 (Item No. 5) for HANDY. The Byrne JAG addendum was approved by the Board on August 16, 2016 (Item No. 11), Resolution No. 2016-360 and will be used with both Memorial and HANDY.

Section 112.313(7)(a), Florida Statutes, provides that "[n]o public officer ... shall have or hold any employment or contractual relationship with any business entity ... which ... is ... doing business with [ ] an agency of which he or she is an officer or employee." In accordance with Section 112.313(7)(a), Florida Statutes, Board approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the County Commission after disclosure of the conflicting relationship (Motion C) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship or Interest, are attached hereto as Exhibit 10 and constitute full disclosure of any existing conflicts.

Fiscal Impact
Fiscal Impact/Cost Summary:
Byrne JAG grant funding in the amount of $195,797 will be available within the Community Partnership Division ("CPD") FDLE Byrne JAG Memorial Justice Grant Funds. Of this amount, $165,468 is allocated to Memorial and $30,329 to the County for PETI.

Byrne JAG grant funding will be available within the CPD FDLE Byrne JAG Memorial Justice Grant Funds in the project amount of $416,692, with $383,266 allocated to HANDY and $33,426 for PETI. Additional funds to address project costs in the amount of $53,582 are designated from Fiscal Year 2019 Children’s Services Administration Section Budget.

Total project funding amount is $666,071. In the event FDLE grant funding ceased, the programs would discontinue. The State and County Fiscal Year references differ for the overlapping periods. The State award references Fiscal Year 2016-2017 for the period starting July 1, 2016 to June 30, 2018. FDLE references to Fiscal Year 2017-2018 refers to the period starting July 1, 2017 to June 30, 2018. The award and implementation for both projects is the County's Fiscal Year 2018-2019.
