Summary Explanation/Background
THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board's Value of “Ensuring economic opportunities for Broward's diverse population and businesses” and Goal to “Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental and community needs.”

The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal of 25% for this project. Stiles Pirtle Joint Venture has committed to meet the CBE participation goal (Exhibit 3).

The purpose of this agreement is to have Stiles Pirtle Joint Venture serve as Managing General Contractor (MGC) to provide preconstruction and construction services for the Cruise Terminals 2 and 4 Parking Garage Improvements project (Project) at Broward County's Port Everglades.

On December 5, 2017 (Item No. 55), the Board approved the Request for Proposals (RFP) No. PNC2114814P1, Managing General Contractor for Cruise Terminals 2 and 4 Parking Garage Improvements.

The project consists of a new multi-story parking garage structure west of Cruise Terminal 4 and an elevated horizontal pedestrian connector from the new garage to Cruise Terminal 2. The project scope includes foundations, concrete structures, concrete entrance and exit ramps, elevators, moving sidewalks, electrical, plumbing, fire protection, mechanical ventilation, roadway improvements, utility work, parking collection systems, closed-circuit television, fencing, security standards compliance, rooftop solar panels, landscaping and other elements. The new garage is designed to provide 1,818 public parking spaces, with the potential to add two additional floors in the structure if demand requires more parking capacity.

The location of the project in Northport will replace an existing 173 space surface parking lot adjacent to Terminal 4. The surrounding area is occupied by active cruise passenger terminals: break bulk unloading, storage and transportation; petroleum unloading berths; the Convention Center; and other port related operations, both maritime and on land. This close proximity will require the MGC to work to minimize impact to the Convention Center and port operations, including deliberately-phased construction.

On March 7, 2018, a Combination Initial and Final Evaluation Meeting was held. The Evaluation Committee (EC) determined that four firms were both responsive and responsible to the RFP requirements. After presentations, evaluation, scoring and ranking, the EC named Stiles Pirtle Joint Venture as the first-ranked firm.

On March 20, 2018 (Item No. 81), the Board approved the EC’s recommendation of final ranking of qualified firms and authorized staff to proceed with negotiations.  

Three Sunshined meetings were held to negotiate this agreement:  April 19, May 1, and May 8, 2018. These meetings were attended by representatives of Stiles Pirtle Joint Venture, the Port Everglades Department and the Purchasing Division.

While formal negotiations between the County and the Stiles Pirtle Joint Venture staffs were concluded on May 8, 2018, there were outstanding issues with insurance requirements to address the unique project construction sequencing, along with the associated legal reviews and modifications to the project scope and Agreement exhibits, that resulted in an extended period of time to finalize the Agreement.

The final negotiated estimated guaranteed maximum price (GMP) of $117,979,172 is comprised of the following estimated GMP price elements:
  1. Preconstruction Services of $648,331;
  2. Direct Construction Cost of $91,421,285;
  3. General Conditions Cost of $8,235,987;
  4. Fixed Fee of $4,484,577; and,
  5. Owner’s Allowance Account of $13,188,992
The agreement includes a preconstruction services period of 219 calendar days. During this period, additional field work will be completed to allow for the completion of the specifications and competitive bidding for the project construction elements. A reconciled guaranteed maximum price will be negotiated and established after all the bids are received. While the substantial completion date and final completion date for construction will be determined during the preconstruction services phase, the current estimated date for the start of construction is April 2019, with substantial completion by October 2020.

Fiscal Impact
Fiscal Impact/Cost Summary:
The source of funding for this project is the Port Everglades Capital Fund. Approximately $25 million has been previously appropriated in the Port’s Capital Budget for construction.
