Broward County Commission Regular Meeting

MOTION TO DIRECT Office of the County Attorney to draft an amendment to Chapter 1, Article XVI, of the Broward County Code of Ordinances ("Ordinance"), regarding the number of members that constitutes a quorum for the Medical Marijuana Advisory Board, to revise the current requirement that a majority of the total membership shall constitute a quorum to allow a majority of appointees (rather than total members) to constitute a quorum.

ACTION:  (T-10:32 AM)  Approved.

VOTE: 9-0.

Pursuant to Section 18.5(e) of the Broward County Administrative Code, the subject matter of a proposed Ordinance must be considered by the Board prior to the drafting of the proposed Ordinance.

Provides required direction to the Office of the County Attorney.

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Medical Marijuana Advisory Board (MMAB) is composed of 12 members; currently, nine memebers have been appointed. Article XVI Section 1-311(d) requires that a majority of the total membership shall constitute a quorum. The MMAB has canceled two recent meetings due to lack of a quorum. At its meeting on September 12, 2018, the MMAB voted unanimously to request an amendment to Section 1-311(d) to allow a majority of appointees (rather than total members) to constitute a quorum, consistent with other County advisory boards.
