The initial contract period begins on the date of award and terminates one year from that date, contingent upon receipt and approval of insurance/performance and payment guaranty.

THE PURCHASING DIVISION AND THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT/ENTERPRISE TECHNOLOGY SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
On March 20, 2018 (Item No. 29), the Board awarded an open-end contract to low responsive, responsible bidder, Advanced Data Cabling and Consulting, Inc. (ADCC, Inc.), a certified County Business Enterprise, for Group 1, Inside Plant Cabling, Bid No. BLD2114202B1, for the Enterprise Technology Services Division. Termination for convenience of Contract No. BLD2114202B1 is mutually recommended by both ADCC, Inc. and the Enterprise Technology Services Division (ETS) due to the vendor's concerns of profitability under the contract terms and conditions, and the County's concerns that the vendor does not operate under a business model conducive to the large geographic scope of the County, and the lack of available personnel for the widely dispersed requests for cable needs by multiple work crews.
The Office of Economic and Small Business Development designated this project as a reserved project for County Business Enterprise (CBE) firms (Exhibit 2).
The purpose of this contract is to provide installation, maintenance and support of inside plant wiring and cabling for various agencies that are served by ETS. The scope of work includes the installation and repair of optical fiber, conduit, cable equipment, and other cable materials for inside applications necessary to ensure technology infrastructure connectivity and preserve voice and data networks. This contract will allow ETS to respond quickly to agency service needs and expedite voice and data network repairs.
Pursuant to Section 1-81.3(e) of the County Business Opportunity Act of 2012, when a CBE reserve is established, CBEs and non-CBEs may respond to the solicitation. If no CBE firm is available to perform the reserved work, a non-CBE firm may be awarded the contract. There is no 25% CBE goal required of the recommended vendor, as the solicitation was awarded prior to the Board approval of ordinance revisions on May 8, 2018 (Item No. 38).
The procurement carries a 50% performance and payment guaranty. The Purchasing Division confirmed with the surety company that ASE Telecom & Data, Inc. has the capacity to obtain the required guaranty.
The allowances in this contract, in the annual not-to-exceed amount of $125,750, include: $10,000 for non-County agency permits and fees; $75,000 for parts, materials and miscellaneous items; $40,750 for specialized subcontractor fees and equipment rental that may be required during the course of this contract and are not covered by existing bid items. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor's actual incurred cost, without mark-up (Exhibit 1).
In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.21, these services are subject to the Workforce Investment Program. ASE Telecom & Data, Inc. agrees to be bound to the contractual obligations of the Workforce Investment Program.
ETS reviewed the bid submitted by ASE Telecom & Data, Inc. and concurs with this award recommendation (Exhibit 3). Ten vendor performance evaluations were completed for ASE Telecom & Data, Inc.; the firm has an overall rating of 4.72 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.
Purchasing Division researched the prices submitted by the recommended bidder, ASE Telecom & Data, Inc., and determined that the prices submitted are fair and reasonable in comparison to the previous Broward County contract and other governmental contracts (Exhibit 4).
The amounts referenced in this agenda were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
