MOTION TO AWARD open-end contracts to low responsive, responsible bidders, Barney's Pumps, Inc. for Groups 4 through 11, 13, and 14, F.J.; Nugent & Associates, Inc. for Groups 1, 2, 12, and 15 through 18, and Grundfos Water Utility, Inc. for Group 3, Items 1 and 3, for Submersible Lift Station Pumps, Parts, and Repair, Bid No. OPN2115473B2, for Water and Wastewater Services and other various County agencies that may have need for these commodities, in the annual estimated amount of $979,586, and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $2,938,758. The initial contract period begins on the date of award and terminates one year from that date.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for award exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

The procurement was initially solicited with a 5% County Business Enterprise (CBE) goal; none of the bidders met the requirement and all bids were rejected. The procurement was re-solicited and the Office of Economic and Small Business Development did not reserve this project for Small Business Enterprises under the Sheltered Market Program or assign CBE participation goals to this solicitation based on the review of products and services requested (Exhibit 3).

The purpose of this contract is to provide submersible lift station pumps used throughout the County to pump wastewater to the treatment facility.

The low bidder for Groups 4, 7, and 10, Grundfos Water Utility, Inc., is a non-local business. Barney's Pumps, Inc., the second low bidder for these groups, is a local business, and its bid amount was within 10% of the non-local bidder's bid amount. Therefore, in accordance with the Local Preference Ordinance, the Best and Final Offer (BAFO) process was extended to Grundfos Water Utility, Inc. (a non-local business) and Barney's Pumps, Inc. (local business). The response to the BAFO resulted in a reduction to the bid amounts by both vendors, and the award is being recommended to the BAFO low bidder for Groups 4, 7, and 10, Barney’s Pumps, Inc. The BAFO resulted in a net savings to the County of $20,855 annually (Exhibit 2).

The low responsive and responsible bidder for Group 12, F.J. Nugent & Associates, Inc., is a non-local business. Barney’s Pumps, Inc., the third low bidder for this group, is a local business, and its bid amount was within 10% of the non-local bidders bid amount. Therefore, in accordance with the Local Preference Ordinance, the BAFO process was extended to F.J. Nugent & Associates, Inc. (a non-local business) and Barney's Pumps, Inc. (local business). No bids were received in response to the BAFO for Group 12, and the award is being recommended to the low responsive and responsible bidder for Group 12, F.J. Nugent & Associates, Inc. (Exhibit 2).

There was no protest or appeal filed regarding this procurement.

Water and Wastewater Services has reviewed the bids submitted by Barney's Pumps, Inc. for Groups 4 through 11, 13, and 14; F.J. Nugent & Associates, Inc. for Groups 1, 2, 12 and 15 through 18; and Grundfos Water Utility, Inc. for Group 3, Items 1 and 3; and concurs with the recommendation for award (Exhibit 4). Six vendor performance evaluations have been completed for Barney's Pumps, Inc.; they have an overall rating of 4.49 out of a possible rating of 5.0. Six vendor performance evaluations have been completed for F.J. Nugent & Associates, Inc.; they have an overall rating of 4.64 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request. There are no vendor performance evaluations completed for Grundfos Water Utility, Inc.

The Director of Purchasing has determined the following low bidders to be non-responsive for the following items and groups:

Barney’s Pumps, Inc. (Item 3-02, Groups 15, 16, and 18); For Item 3-02, Group 15, and Group 16, Barney’s Pumps, Inc., offered a pump that exceeded the maximum rated horsepower (HP) as specified in the Item Description Specification of the solicitation. For Group 18, Barney’s Pumps, Inc., did not bid on all line items of the group, as the specified basis of award and required in the bid comments section of the solicitation.

F.J. Nugent & Associates, Inc. (Item 3-02); For Item 3-02, F.J. Nugent & Associates, Inc., offered a pump that does not meet the discharge as specified in the Item Description Specification of the solicitation.

Grundfos Water Utility (Groups 1, 2, 9, 12, 13, 15, 16, and 17); For Groups 1 and 2, Grundfos Water Utility, the bidder did not bid on all line items of the group, as the specified basis of award and required in the bid comments section of the solicitation. For Groups 9, 12, 13, 15, 16, and 17, Grundfos Water Utility offered pumps that exceeded the maximum rated horsepower as specified in the Item Description Specification of the solicitation.

All bids have been rejected for Groups 19 and 20 which were for repair services and repair parts respectively. Upon review, it was determined that these Groups should be re-solicited to allow for award to multiple firms on each Group. Submittals to that re-solicitation are in review for subsequent award.

Incumbents: Barney’s Pumps, Inc. and F.J. Nugent & Associates, Inc. Contract Number and Title: Y1308004B1, Submersible Lift Station Pumps, Parts and Repair. Contract Term: March 20, 2015 through June 17, 2018. Expenditures to date: $1,617,103.

Incumbents: Barney’s Pumps, Inc. and F.J. Nugent & Associates, Inc. Contract Number and Title: Interim Contract Y1308004BX, Submersible Lift Station Pumps, Parts and Repair. Contract Term: June 18, 2018 through December 14, 2018. Expenditures to date: $52,043.

On June 29, 2018, the Director of Purchasing approved the Interim Contract Number Y1308004BX to Barney’s Pumps, Inc. and F.J. Nugent & Associates, Inc. in the not-to-exceed amount of $178,000 utilizing the same pricing, terms and conditions of Contract Number Y1308004B1 in order to provide these commodities and services through September 15, 2018. On September 06, 2018, the Director of Purchasing approved a three-month extension of Interim Contract Number Y1308004BX with Barney’s Pumps, Inc. and F.J. Nugent & Associates, Inc. in the not-to-exceed amount of $178,000 utilizing the same pricing, terms and conditions of Contract Number Y1308004B1 in order to provide these commodities and services through December 14, 2018.

The bid validity for this project expired on August 25, 2018. Barney’s Pumps, Inc., F.J. Nugent & Associates, Inc., and Grundfos Water Utility, Inc.,  agreed to extend their bid validity through October 31, 2018 for Bid Number OPN2115473B2.

The bid posted on April 6, 2018 and opened on April 27, 2018; three bids were received with no declinations (Exhibit 1).
