MOTION TO ADOPT Resolution No. 2018-447 accepting a Drainage Easement located at North Course Lane in Pompano Beach from Palm Aire Associates Limited Partnership, a Delaware limited partnership at no cost to the County; and authorize the Mayor and Clerk to execute and authorize recordation of same. (Commission District 2)

Board of County Commissioners' approval is required to accept an interest in real property pursuant to Broward County Administrative Code, Section 6.23.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Palm Aire development is located off Powerline Road, south of West Atlantic Boulevard. The association for the development, Palm Aire Associates Limited Partnership made certain improvements to its common areas including newly excavated lakes. The Water Management Division requires a drainage easement to install, operate, maintain, repair, and replace drainage structures and appurtenant equipment for drainage, retention and outflow of surface water from the newly excavated lakes to existing pipes leading to the C-14 canal which runs parallel to Atlantic Boulevard. The proposed 20-foot-wide drainage easement lies south of West Atlantic Boulevard and west of Powerline Road and is located in the common areas of the Palm Aire development identified by Folio Number 4942-04-00-0062.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
