MOTION TO APPROVE Third Amendment to Agreement between Broward County and Advanced Pharmaceutical Consultants, Inc. (APC), in the not-to-exceed amount of $273,732, effective December 1, 2018, through November 30, 2019, to provide pharmacy and medication management services to Broward County residents receiving substance abuse treatment at Broward Addiction Recovery Division’s 24-hour detoxification facility; authorizing Mayor and Clerk to execute the Agreement; authorizing the County Administrator to execute amendments to the Agreement, subject to approval of the same by the Office of the County Attorney; and authorizing the County Administrator to take all administrative and budgetary actions to implement the Agreement.

Why Action is Necessary
In accordance with Section 21.31(a)(4), Procurement Code of Broward County, the Board is required to approve all awards exceeding $500,000, including multi-year agreements meeting this threshold. Furthermore, Section 21.31(g), specifies no contract shall be renewed beyond five years without the consent of the Board.
What Action Accomplishes
This Agreement allows BARC to meet Community Pharmacy Licensure requirements from the State of Florida Department of Health by providing licensed pharmacy staff to manage and operate in-house pharmacy and medication services at the BARC Detox facility.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE BROWARD ADDICTION RECOVERY DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board's Value of "Approaching human services collaboratively and compassionately, with special emphasis on the most vulnerable,” and Goal to “Deliver evidence-based services to the public, and connect customers and their family members, to sustainable support, with special emphasis on financial supports.”

APC provides in-house pharmacy and medication management services to Broward County residents receiving substance abuse treatment at BARC’s Detox facility. APC manages the automated medication distribution system for enhanced patient safety and medication accountability in accordance with state and federal statutes and Joint Commission accreditation requirements. The APC licensed pharmacist is qualified to order wholesale prescription medications on behalf of the County, under an existing agreement between Broward County and the Minnesota Multi-State Contracting Alliance for Pharmacy (MMCAP), a group purchasing organization for government-authorized health care facilities.

The APC Agreement resulted from the Request for Letters of Interest (RLI) No. R1012809R1 for In-House Pharmacy Management Services approved by the Board on December 10, 2013 (Item No. 25). On April 8, 2014, Director of Purchasing approved the First Amendment to address Enterprise Technology Services' (ETS) security and HIPAA requirements. On September 4, 2015, Director of Purchasing approved the Second Amendment to address the new BARC Narcotic/Opiate Treatment Program license and regulatory changes requiring a pharmacist.

The Third Amendment will add an option period and to revise the Scope of Services to support BARC’s Medication Assisted Treatment (MAT) program and the new 50-bed, 24-hour detoxification facility. Detoxification protocol is contingent upon in-house pharmacy services to detox its patients. The MAT program uses medications in combination with counseling and behavioral therapies for the treatment of substance use disorders which has been proven to promote sustained recovery. The Third Amendment will ensure continuity of pharmacy services at the new facility and allow time for a solicitation to be conducted for provision of qualified in-house pharmacy and medication management services.

APC has met all performance measures to date.

This Agreement has been reviewed and approved as to form by the Office of the County Attorney. Once received, the signature pages will be noted in the Monday Night Memo.
