Why Action is Necessary
A., B., and C., In accordance with the Broward County Procurement Code, Section 21.54.c, the Board must approve standardizations over the award authority of the Director of Purchasing, and Section 21.14.c.6, the Director of Purchasing shall execute all contracts and amendments delegated by the Board for the Director's execution, and Section 21.43, a contract for supplies or services of more than five years must have the express consent of the Board.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE DEPARTMENT OF REGIONAL EMERGENCY SERVICES AND COMMUNICATIONS/OFFICE OF REGIONAL COMMUNICATIONS AND TECHNOLOGY RECOMMEND THE APPROVAL OF THE ABOVE MOTIONS.

On August 27, 2013 (Item No. 59), the Board approved the sole source, sole brand standardization for Motorola radio system maintenance and repair for radios as necessary for the legacy 800 MHz Public Safety Trunking Radio System (Radio System), and for the Motorola public safety system licenses and intranet maintenance and support for the Office of Regional Communications and Technology.

The County’s Trunked Radio System has been in service since 1990 and is used as a primary or backup means of communication for all fire rescue and police departments in Broward County.

The purpose of this action is to reaffirm the standardization of Motorola as approved on August 27, 2013, and to modify the standardization to include Motorola Hosted Master Site Services as an integral component to the Radio System. The Motorola Astro25 Hosted Master Site (HMS) controls the flow of voice traffic on the County’s Radio System. The HMS is installed and managed through Motorola and is located at its Plantation facility. Ongoing maintenance and support of the Trunked Radio System is critical to the public safety users until the new system is implemented and to allow the County to transition to the new P25 Phase II radio system.

On December 1, 2011, Broward Sheriff’s Office (“BSO”) and Motorola entered into a South Florida Master User Agreement, including a Software License Agreement and Communications System Agreement, providing for Motorola to provide a connection to the HMS ( “Master User Agreement”).

The Master User Agreement was assigned by BSO to the County pursuant to an Assignment, Delegation and Release Agreement, dated April 5, 2013, under authority delegated by the Board to the County Administrator on October 9, 2012 (Item No. 41), to enter into system maintenance agreements for regional assets, operation agreements, municipal interlocal agreements, and any other agreement that may be necessary to expedite the implementation of regional communications through the Office Of Communications Technology, now known as the Office of Regional Communications and Technology.

The Assignment continued the term of the prior Master Site Agreement, which was in effect for an initial period of five years from the execution date (December 1, 2011), with two one-year renewal options.

This First Amendment to South Florida Master User Agreement extends the Master User Agreement for an additional three optional one-year renewal terms (for a new total of five optional one-year renewal terms) potentially allowing renewals through November 30, 2023, at the annual fee of $150,000 to be paid monthly in arrears.

On December 13, 2013, the County Administrator executed the Master Maintenance and Services Agreement between Broward County and Motorola Solutions, Inc. (“MSA Agreement”) for continued maintenance and support of the County’s Radio System, Computer Aided Dispatch/Application Support, and Public Safety Intranet Services, in the not-to-exceed amount of $12,166,213. Execution of the MSA Agreement was noted to the Board on January 14, 2014 (Item No. 10).

There were four subsequent amendments to the MSA Agreement, collectively increasing the total not-to-exceed amount from $12,166,213 to $14,938,819. The initial term of the MSA Agreement was from January 1, 2014, through September 30, 2017, with the option to extend the MSA Agreement for up to two one-year extensions. This Fifth Amendment to the MSA Agreement extends the duration of the MSA Agreement for an additional three optional one-year renewal terms (for a new total of five optional one-year renewal terms) through September 30, 2022, to allow completion and transition to the new Project 25 (P25) Phase II radio system. This increases the total not-to-exceed amount to $19,438,819.

The new P25 Public Safety Radio System is expected to be completed by the fourth quarter of calendar year 2019. Once the transition and migration of the radio system users are completed, the Hosted Master Site Agreement and the Master Maintenance Agreement services will no longer be needed and can be terminated or not extended, as applicable.
