Requested Action
MOTION TO DIRECT Office of the County Attorney to draft an amendment to Chapters 8, 25, 27, 38 and 40 of the Broward County Administrative Code, and to amend Chapter 5 of the Broward County Code of Ordinances, in order to transfer responsibilities for petitioning for vacation of plats, abandoning places and areas used for travel, and the release of other public and private interests on land from Real Property Section to the Planning and Development Management Division.

Pursuant to Section 18.5(e) of the Broward County Administrative Code, the subject matter of a proposed Ordinance must be considered by the Board prior to the drafting of the proposed Ordinance.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

In the Fiscal Year 2019 budget, the Board transferred funding for the Vacation Petition Program from Real Property Section to Planning and Development Management Division (PDMD). This change is intended to improve efficiency and positively impact customer service. To implement this change, the following code sections relating to petitioning for vacation of plats, abandoning places and areas used for travel, and the release of other public and private interests on land require amendment:
  • Chapter 8, Part IX, Broward County Administrative Code,  to assign responsibility for managing the process to PDMD;
  • Chapter 25, Part XVI, Broward County Administrative Code, to consolidate the regulations and procedures within the Broward County Land Development Code; and
  • Chapter 38, Part II and Chapter 40, Part I,  Broward County Administrative Code, to relocate the existing fees to the Environmental Protection and Growth Management Department fee schedule.
