THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
On August 1, 2018, the County entered into a Contract for Sale and Purchase with BCAD 4 & 5, LLC (Purchaser) for the sale of a County-owned property comprised of eight parcels located on SW 22nd Avenue one block west of Ravenswood Road in Dania Beach and identified by Folio Numbers 5042-29-01-0051, 5042-29-01-0052, 5042-29-11-0110, 5042-29-11-0100, 5042-29-11-0091, 5042-29-11-0090, 5042-29-11-0081 and 5042-29-11-0080 for a purchase price of $1,800,000. This property is one of sixteen which are required to be sold under the settlement agreement with the City of Dania Beach.
The Contract for Sale and Purchase provides the purchaser with a due diligence period during which purchaser can determine if the property is suitable for development. Due to its proximity to the airport, the property will be subject to a Declaration of Covenants, Restrictions and Easements imposed by the County which states that it shall be used solely for nonresidential purposes. The property is currently zoned RM-1 Residential which is inconsistent with the Declaration of Covenants, Restrictions and Easements. Rather than cancel the Contract for Sale and Purchase, purchaser would like to rezone the property to IROM AA (Industrial). However, as BCAD 4 & 5, LLC is not the current owner, BCAD 4 & 5, LLC needs authority from the Board of County Commissioners to act as an agent of the County solely for purposes of rezoning the property from RM-1 to IROM AA.
