MOTION TO DIRECT Office of the County Attorney to draft an Ordinance amending various sections of the Broward County Code of Ordinances and a Resolution amending various sections of the Broward County Administrative Code to continue implementing efficiencies and housekeeping measures associated with creation of the Environmental and Consumer Protection Division (ECPD) by amending the process for changing of taxicab rates; resolving the regulatory end date for automatic CPI based fee increases for towing and immobilization; and relocating the towing and immobilization fee schedule to Chapter 40 of the Administrative Code.

Why Action is Necessary
Board action is required to direct the Office of the County Attorney to draft an Ordinance amending the Broward County Code of Ordinances.
What Action Accomplishes
Permits the Office of the County Attorney to draft a proposed Ordinance to update taxicab, towing and immobilization fee requirements and move the towing and immobilization fee structure to Chapter 40 of the Administrative Code.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL AND CONSUMER PROTECTION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board's Value of Consistently delivering responsive, efficient, quality services to the public and internal customers and Goal 4: Build into every process and service effective checks and balances that do not cause inefficiency, but rather ensure consistency, continuity, and quality.

Approval of this item allows the Office of the County Attorney to draft a proposed Ordinance implementing housekeeping and efficiency measures associated with taxicab and towing fares.

Proposed Ordinance revisions to implement the above changes include:
  1. Revising the biennial review of taxi fares to allow taxicab fare increases to be brought to the Board whenever a fare increase is proposed.
  2. Resolving the regulatory end date for automatic CPI based fee increases for towing and immobilization maximum fees (Chapter 27 of the Administrative Code) and associated licensing fees (Chapter 40 of the Administrative Code). Currently, the regulatory requirement is to increase fees based upon the CPI until October 2019, at which time the Board is to reevaluate. This change would maintain the existing annual CPI based fee increase for the foreseeable future (as is consistent with, for example, the Child Care Licensing and Enforcement fee schedule).
  3. For consistency, moving the towing and immobilization fee schedule from Chapter 27 of the Administrative Code to Chapter 40, where most fees are listed (including Taxicab fares).
