THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action will approve a new Agreement between Broward County (“County”) and the City of Dania Beach, Florida (“City”), relating to the replacement of the existing welcome sign and associated landscaping at the S.W. Corner of U.S. Highway 1 and Griffin Road (“Agreement”).
On January 9, 2001 (Item No. 2), the Board approved an agreement (“2001 Agreement”) with the City, wherein the County agreed to construct and install a welcome sign and landscaping at Griffin Road and U.S. Highway 1 (“Prior Improvements”), and the City agreed to maintain such Prior Improvements. Thereafter, the County constructed the Prior Improvements in accordance with the terms of the 2001 Agreement.
On November 19, 2013 (Item No. 7, Motion A), the Board approved an interlocal agreement (“2013 Agreement”) with the City, wherein the County agreed to replace the Prior Improvements with a new welcome sign and associated landscaping at a cost not-to-exceed $250,000 (“Replacement Provision”), and the City agreed to be responsible for the maintenance and any electricity expense related to the new welcome sign and associated landscaping.
In the proposed Agreement, the City and the County revised the terms of the Replacement Provision in the 2013 Agreement (Section 5.c.) as follows: instead of County replacing the Prior Improvements, City will replace the Prior Improvements and County will reimburse such work at a cost not-to-exceed $250,000. All other terms of the prior 2001 and 2013 Agreements remain the same.
Pursuant to the proposed Agreement, the City will at all times, at its sole expense and in perpetuity, maintain and repair the approved sign and landscaping improvements in accordance with the Agreement.
Substantial completion of the City’s construction and installation of the approved sign and landscaping improvements must be achieved within 180 calendars days of the effective date of the Agreement, or a longer time period of time if agreed to by the City and the County. All County funds will be paid on a reimbursement basis and upon submittal of an invoice from the City after substantial completion. Approval of the proposed Agreement reimburses the City in the not-to-exceed amount of $250,000 for work related to the replacement of the existing welcome sign and landscaping at the S.W. corner of U.S. Highway 1 and Griffin Road.
The proposed Agreement has been reviewed as to form by the Office of the County Attorney and the Risk Management Division.
