MOTION TO APPROVE First Amendment to Pipeline License Agreement between Broward County and Florida Gas Transmission Company, LLC, at Broward County's Fort Lauderdale-Hollywood International Airport to revise the indemnification and insurance requirements, and to extend the termination date from November 30, 2018, to November 30, 2023; and authorize the Mayor and Clerk to execute same.

Why Action is Necessary
Chapter 2, Section 2-40 (a) of the Broward County Code of Ordinances, requires that Broward County Board of County Commissioners ("Board") authorize any commercial activities or occupation of any portion of the airport.

Approves First Amendment to revise indemnification to Broward County ("County") and insurance requirements; and to extend the term of the Pipeline License Agreement until November 30, 2023.

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

This action approves the First Amendment to the Pipeline License Agreement between Florida Gas Transmission Company, LLC ("FGTC") and Broward County to revise the indemnification and insurance requirements to the County, and to extend the term of the Pipe License Agreement through November 30, 2023.

The first Pipeline License Agreement was approved by the Board on October 17, 1967. Additional information on the original agreement and subsequent Board actions is included in Exhibit 3.

On May 06, 2014 (Item No. 3), the Board retroactively approved a Pipeline License Agreement between the County and FGTC, for the continued operation and maintenance of the pipeline effective December 1, 2013, and terminating on November 30, 2018.

The proposed First Amendment allows FGTC to continue the construction, maintenance, repair, and operation of the pipeline on FLL property until November 30, 2023. Additionally, the proposed First Amendment updates the indemnification provision and insurance requirements.

The proposed First Amendment has been reviewed as to form by the Risk Management Division and the Office of the County Attorney.

The amount referenced in this agenda has been rounded to the nearest whole dollar. FGTC’s payments will be based on the actual amount payable under this Pipeline License Agreement. The agreement summary sheet reflects the actual amount payable.

Fiscal Impact/Cost Summary:
FGTC currently pays the County an annual license fee in an amount equal to $23,774. The license fee is adjusted annually by 3% or CPI, whichever is greater.
