MOTION TO APPROVE Agreement of Lease between Broward County and JetBlue Airways Corporation at Broward County's Fort Lauderdale-Hollywood International Airport for 7,223 square feet of space in the County-owned air cargo facility, effective upon approval by the Broward County Board of County Commissioners and terminating on the last day of the fifth lease year; and authorize Mayor and Clerk to execute same.

ACTION:  (T-10:28 AM)  Approved.

VOTE: 8-0. 

Chapter 2, Section 2-40 (a) of the Broward County Code of Ordinances, requires that the Broward County Board of County Commissioners ("Board") authorize any commercial activities or occupation of any portion of the airport.

Allows JetBlue Airways Corporation ("JetBlue") the use of two cargo bays to support its activities related to a scheduled aircraft carrier operation at Broward County’s Fort Lauderdale-Hollywood International Airport ("FLL").

THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

This action allows JetBlue the use of two cargo bays to support its activities related to a scheduled aircraft carrier operation at FLL.

The proposed Agreement of Lease ("Lease") allows JetBlue the use of two cargo bays, specifically bay 2A and 2B, measuring a total of 7,223 square feet in the County-owned cargo building facility. The term is for a period of five years commencing upon approval by the Board and terminating on the last day of the fifth lease year. The total annual rental during the first lease year shall be $117,374, plus applicable taxes, adjusted annually, beginning with the first day of the second lease year, by the greater of 3% or the consumer price index.

The Lease has been reviewed by the County Risk Management Division and approved as to form by the Office of the County Attorney.
