Requested Action
MOTION TO ENACT Ordinance adopting a Small Scale land use plan amendment to the Broward County Land Use Plan, PC 18-8, in the City of Deerfield Beach, to the Broward County Comprehensive Plan (Commission District 4), the substance of which is as follows:

AN ORDINANCE OF BROWARD COUNTY, FLORIDA, ADOPTING A SMALL SCALE AMENDMENT TO THE BROWARD COUNTY COMPREHENSIVE PLAN; AMENDING THE BROWARD COUNTY LAND USE PLAN WITHIN THE CITY OF DEERFIELD BEACH; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

ACTON:  (T-12:00 PM) Filed proof of publication and enacted the Ordinance to become effective as provided by law, as amended and conditioned upon payment in advance of issuance of permits for construction and $163,000 paid to City of Deerfield Beach Affordable Housing Trust Fund.  (Refer to minutes for full discussion.)

VOTE: 9-0.

ACTION: (T-12:14 PM) Approved, as amended, recognizing the applicant’s voluntary commitment to pay $500.00 for each dwelling unit totaling $163,500 toward the City of Deerfield Beach Affordable Housing Programs with effectiveness of approval not to occur until recordation in the public records of Broward County of a legally enforceable document in a form to be approved by the County Attorney’s Office regarding the Affordable Housing commitment proffered by the applicant as an inducement for Broward County to favorably consider its application.  (Refer to minutes for full discussion.)

VOTE:  8-1.  Commissioner Rich voted no.
Why Action is Necessary
Pursuant to Section 163.3184(11), Florida Statutes, as amended, Broward County Comprehensive Plan amendments shall be adopted by Ordinance by the Broward County Board of County Commissioners, serving as the local governing body.
What Action Accomplishes
The Ordinance adopts Broward County "Small Scale" Land Use Plan map amendment PC 18-8, in accordance with Section 163.3187(1), Florida Statutes, as amended.

Summary Explanation/Background
The Planning Council, as the Local Planning Agency (LPA) responsible for the Broward County Land Use Plan, considered the following proposed small scale amendment, PC 18-8, at its May 24, 2018, public hearing and recommended approval. Further, the City of Deerfield Beach should provide additional information regarding affordable housing by the Planning Council's second public hearing. (Vote of the Planning Council; 10-3; Yes: Blattner, Breslau, Castillo, DiGiorgio, Ganz, Moraitis, Rosenof, Rosenzweig, Williams and Stermer. No: Blackwelder, Graham and Grosso) and also recommended approval at its August 23, 2018, public hearing, subject to the applicant’s voluntary commitment to restrict the building height to a maximum of six (6) stories (Vote of the Planning Council; 11-4; Yes: Blattner, Breslau, Brunson, Castillo, DiGiorgio, Ganz, Gomez, Good, Rosenof, Rosenzweig and Stermer. No: Blackwelder, Graham, Grosso and Rich):

AMENDMENT PC 18-8
Amendment to the Broward County Land Use Plan - City of Deerfield Beach

From 7.6 acres of Low-Medium (10) Residential, 0.5 acres of Commerce, and 0.3 acres of Low (5) Residential to Irregular (39) Residential.

Approximately 8.4 acres; generally located on the east side of Northeast 1 Avenue, between Northeast 5 Street and Dixie Highway.
